You haven't paid for it, so it's not yours. Send it back. Forget about copyright and treat it as item not described properly. You can also report it to ebay as counterfeit and they might remove his account.

Technically he didnt send you a proper copy of XP so you are right to get the refund, it just happens that he sent you a large cd shaped coaster out of his own generosity at the same time

It might be a lie, but he may not have realised its counterfeit and be in a similar situation to you and need to return the item for himself to get a refund, and may have just refunded you out of his own pocked for now. I'd send it back, signed for is only an extra 75p

So? It's down to the seller to check their items before they sell them on, regardless of where they came from.

Either send the discs back or if you feel so strongly about piracy then report it

Tell them you took it to Trading Standards and they confiscated it.
Also tell them you gave the Ebay details too.
The Police wouldn't touch a case like this.
