Sorry, but how is downloading from rapidshare any different? You're relying on the file being as its labeled, the same way you rely on the torrent being labeled correctly. But nearly all torrent search sites let you comment on torrents to say if they are right or not, while you can't comment on rapidshare files.

Like i said, if your using a warez forum thats modded and has a high amount of people downloading the links, then dead links or just links that arent what they say they are get routed out very quickly.
Also: how has this not been locked yet?
Won't it be the same with torrents? Search sites lite you comment to say if it is good or not, and if it isn't then people won't stay around and seed it. Though I agree with the speed part, torrents need lots of seeds to get up to a good speed. That said, there's this person in Finland I'm connected to for this torrent who's maxing out my download. He's uploading at 200kb/s and he's not even a seed, he's downloading it too. No fair
Thing that's good about rapidshare is that files always max out my connection whereas torrents depend on the amount and quality of the seeders (and also leechers) and so some extent the tracker you use. Torrents one the other hand are far more reliable in that they don't often go down and are for the most part free.

Someone using the account could download child porn or terrorist stuff or whatever and he would be arrested for it.
