Rear Ended

I was just out and about doing a few odd tasks ready for Xmas and got rear ended by White Van.

I was giving way to a car and a few seconds later I got nailed from behind.

Here is a pic of the damage:

At the time I was very shaken up but counted to 3 and thought what I have read on here so got out the car and walked up to the bloke.

He said "WTF you stopping for on a busy road"

I just said I was giving way to a car and you hit me from behind.

A guy stopped as a witness who I am very grateful of.

I called my Dad but got no answer so called the police, gave details etc... and then asked what to do.

So I took the witnesses and white van man's details, the white van man said he doesnt know his insurance company so I will phone him later to find that out.

My neck and back are very uncomfortable so going to get that checked out now.

Could you please advise what to do?

I havn't contacted any insurers as of yet.

I am worried that I will need to pay an excess, I always though I wouldn't need to if it wasn't my fault, also do i lose NCB?

I am assuming the insurers will see it as his fault, I have that kind witness too.

My doctor said to go to hospital for an xray, it's aching a fair bit already :(

The side panel has all crumpled, the bar across the back is twisted and buckled, the boot is a little buckled and will not open, the light has gone, paint work is all crap. Do you really think they will repair it? Suspension is knocking.
 
Just phoned insurers.

They chap was really helpful.

I have legal cover so have a number to call all about claiming from his insurance.

I am going to A&E now, the chap on the phone advised it and said to call back after I have been checked out.

I have had to ring my customers and cancel my appointments - Not good as money would be handy this time of year :(

I had stopped for 2-3seconds before the van hit me, and he never hit me square on as you can see from the pictures.

I will call the witness later, I think it would be a nice gesture to buy him something as a thanks, what do you suggest.

So is it a write off job?

Oh, I have £500 ICE cover on the car, the amp looks ok but I can't get to the sub as it's stuck in the boot, definately been chucked about though as I folded down the small seat and the sub is on the other side of the boot.
 
Just back from A&E. I have bad bruising but nothing is broken (what I thought).
The Dr. said the insurers can contact the hospital for the record.

That's what I was concerned about so won't do it atm.

I am just about to do some more calling around.

My Dad said I should take out the ICE from the car. Should I remove anything else?
 
Can I take things like my ST grille off etc...?

The GhiaX has lots of little things that are sought after on the owners club.
 
I have taken out the amp sub and HU.

Also a few things i added like chrome interior handles (off of newer Mk2 mondeo) and also the leather Ford gear knob as I can replace these with the bits I have.

I had to hack up the original grille to make the ST one.

I will put the original HU back in, it isnt worth anything anyway as the LCD is broken on it.

What do you mean damaged screen?

If they value it at a stupid amount I will tell them where they can go.

My mileage is 93K. I hit the 6month of ownership a few days ago and 5K miles this morning, bloody typical!

I hope the company Fox recommended (www.helphire.co.uk) can get a hire car to me tomorrow. What's the deal with insurance on a hire car?

One thing to mention about Helphire... I used them ~18 months ago when my Mondeo was written off. It was all great at the time but I got a letter recently telling me I am contractually obligated to attend a court hearing to enable them to recover their costs (totalling £4000) from the 3rd party. There was no mention of where the hearing will be held - it could be in Scotland for all I know!
They are based in Bath so I imagine it's around there.
 
As you lot are so sure that it's a write off, to be honest I'm not sure if I would be confident driving it again as I think it would need a rejig and the suspension is knocking on that corner now. Also the rear passenger door is jamming and when you open it the handle stays up and you have to push it down before closing the door.

Current things I am considering replacing it with:

Thoughts on the above. Insurance could be an issue on the 520i, the Mk3 GhiaX is actually a group lower than my current car. I could get the Mk3 Ghia X in diesel or estate variety too.

I am waiting on a call back from helphire and NUD/Asda Legal team today.
I am going to inform the Asda legal people that I am seeking help elsewhere but will try and find out his insurer first.

Helphire said they pass my info to admin who then process it on the system and will then call me back. The only issue so far is that I don't know the other guys insurer so they said they will have to find that out, I am quite sure he is as the last owner change on his vehicle was 2002 so he must have had to of bought tax in that time.

What are the chances of getting a hire car sent to me today?

My back and neck are aching today, yesterday it was coming and going but today it is constant. It's not a severe pain but as it's constant so it's pretty annoying. I have an interesting work arrangement tomorrow where by I am working with a chap for free and he is going to show me a lot of things regarding aerials and signals. I hope the ache doesnt persist as I will be doing lots of ladder climbing and lifting tomorrow.

I am expecting them to write it off, if I get the option to buy her back relatively cheaply I will as lots of people on the owners club would appreciate bits and it would be better to be broken on there than squashed by a big crusher.
 
Was holding the car on the foot brake, my brake lights were all operational, the car has what's called AWS which alerts me when brake lights are out and I do a visual check once per week. I have a high level break light too.

I think he hit me at full speed, probably 30-40mph on the stretch of road we were on, luckily I am always conscious of my distance from the car infront so didn't get shunted into that.

The way he has bit me, perhaps he was changing lanes and not looking where he was going? The road has 3 lanes on this particular stretch. Perhaps he thought he could drive around me and mis judged it. I think he had a passenger in the van, maybe he was paying more attention to the passenger than the road.

I will probably never know.

I was trying to recreate the scene in my head last night and I don't think he did swear so want to correct myself on that. He however did walk towards me as I walked towards him and said "what you doin' stopped on a busy road for?" He sounded quite angry with me for being stationary.

I felt like saying "What the hell are you doing rear ending people on a busy road for?".
I just kept cool and explained I had to give way to a car blocking the road and had stopped for a couple of seconds before you had hit me.

I knew it wasn't my fault though so had no reason to argue back or get aggresive so left it, he asked for my insurance details which I did provide him with, when I called the police I was informed to do this. I think there is a good chance that he will make up some bull which is why I am so greatful for this chap stopping and giving me his name, address and phone number.

I can assure myself that I had slowed steadily for the obstruction I faced as I was in 1st gear, If I had slammed on the brakes I would have still of been in 4th gear.

All across the top of my back is aching the most today. Neck isn't very bad at all though.

This will sound really stupid but around this time last year I had my first driving test, I wanted to pass it so much so on Xmas day I could do all the driving to see all the family and mum and dad could have a little xmas drink etc...

Unfortunately I failed my test but passed on 4th Jan, first test of 2005 in the UK :cool:.

So I have been waiting almost an entire year to do this, now it has been snatched away from me :(

I know this sounds pathetic but means something to me.

Helphire just contacted me, we are sorting everything.

The lady has to call me back as she is now trying to chase up the chaps insurance details. Finally getting somewhere!
 
Helphire just called back.

The chap will not tell them his insurance details.

Apparently all of my brake lights are at fault and he has contacted the police regarding this.

Therefore helphire are unable to help :(

Please Advise as I am now very concerned.

I may go and take a pic of the break lights functioning next to a bank statement I received today.

No.

I do have AWS which alerts me of faulty lights though. Guess what? No alerts, also i have just been out to the car and bar the one he broke they all work.
 
I have his registration plate.

I have also checked out his name, address and phone number via BT and it all checks out ok.

Today's bank statement has an earlier date on, I'll get todays newspaper instead.

Has anybody used RAC accident care? They sound like helphire really.

I'll wait to here from merlin first.

Not too sure what he is up to tbh. lol. He is just reassuring me things should be ok and he is pulling some strings for something helpful somewhere.
