Rear Ended

Merlin recommended a good solicitor who has been really helpful.

The chap is insured but hasnt reported the accident to his insurers, so it will take a little longer to do things as his insurer will not accept responsibility yet.

I am waiting on a call from a rental company now as I need the car to work it is being provided. :)
 
I am expecting a call from a hire company today, I hope they can get a car to me today, REALLY need it now!

This morning I was having a look at the damage from inside the car, looks nasty and all mangled up. I did find wedged inbetween the mess of metal and plastic the actual frame which all the bulbs plug into, all of the bulbs are still intact and unbroken :eek:

God knows how, I havn't tested them all but the indicator bulb works. lol.

Update:

Turns out the guy isn't insured with the company on the database as he cancelled his policy with them at the beginning of December. I think it will get worse now, much worse.

Dad has offered me a loan to get myself a new car, probably going to get another Mk2 GhiaX as I love them. Then pay him back once this is sorted but I reckon it will be a long process now :(

Cannot get hire car as they have no insurer to charge, so I am back onto my Mum's Micra insurance so I can continue with my job.

No, the solicitor was very assuring saying there are many legal avenues etc... and I will end up with something.

There is also basically a pot for people to claim from when hit by uninsured drivers but a £300 excess is involved on this.

I will next here from the solicitor on the 3rd of Jan, he said that gives the database a chance to update if need be, all the companies including himself are off over xmas and new year and also he can get a letter out to the chap about the matter.

I phoned them and they asked me to report the accidnet, I told him I already did hen I phoned the police at the scene of the accident. I have to report the accident in a police station instead. Talk about wasting police time.

I don't like putting a downer on the police but the bloke was really rude on the phone so I didn't care to talk to him much. I am going to sit tight and make-do untill I next hear from the solicitor. I imagine it will come round soon enough with this busy time of year anyway.
 
The reason I may pay an excess is that I would be claiming from nobodies insurance.

I have arranged my own solicitor as Asda legal team didn't contact me when they said they would and when they finally did they rang the home number (gave them mobile to call) so left a message and are sending me out paperwork aswell as the solicitor.

The solicitor I think will be a better option as I have spoken to him a fair bit and he understands my concerns.

The main thing is I get a car, my Dad said it isnt a problem to lend me a bit of money to go and get something.

I am going to get another GhiaX Mk2 as I know them inside out now.
I am going to aim for a MY2000 V/X reg with average miles, FSH and of course a minter.

Can the legal expense cover I have be applied to my own solicitor?
Or would I have to use the solicitors my insurer uses?
 
I did post earlier that I found out today that the chap that hit me IS insured on some sort of trade policy.

His insurer had no report of the accident. So they cannot accept liability until they speak to or somehow contact him.

How long am I looking at to get some money / fixed car then?
 
That's basically what has happened but the solicitor is doing the work as apposed to my insurer.

The current problem is the bloke who crashed into me hsnt reported any accident to his insurer so they will not accept liability just based on my story.

That's understandable of the insurer but why the bloke hasnt reported anything is beyond me. He is acting like a ****, infact he is a ****. What does he expect to achieve by acting like this?
 
There is a message on the phone confirming it is a write off and that I should phone to discuss value :)
 
I HAD to stop as the car had pulled out from the side of the road blocking my lane.

If I hadn't of stopped I would have hit the N/S wing of the car.

I didn't brake suddenly either and it was 2-3seconds after stopping that the van hit me.

Even if I did brake suddenly I am entitled to do so for whatever reason I wish, he is not entitled to crash into me.

I accepted £1100 for my Mondeo.
And am buying it from the insurance company for £60.

I did ok beating the bloke up from £900 I thought. We both had Autotrader website open and agreed on a value off of there.

The car is a Cat B Write Off! :eek:

Doesn't mean I cannot brake it for spares though ;)

I'm going to drive te rover until I have 1yrs NCB which comes along in June and save a bit when I can afford to adding to the Mondeo money so come summer time I should have a nice little saving and to buy a car and try to pay insurance out right instead of monthly.

I will probably get another Mondeo Ghia X but tbh I am so tempted to buy an MX-5. That's if my business is turning over enough to warrant a work van which I hope it is - MX-5 would be crap for work! :)
 
Update:

Still haven't received a cheque, should have had it 3 weeks ago, thats allowing 2 weeks to send aswell so a total of 5 weeks!

I sent them a letter last week. Turns out they wont give me a cheque unless I send them MOT and V5. They just forgot to tell me and my solicitor this.

I no longer have the V5 as have declared the vehicle being scrapped/broken so called the DVLA and they sent me a note saying I owned the car.

I now have to forward these to the solicitor. It's a right ****-take!

EVERY morning I wake up with an aching shoulder and breast-bone. I was hoping this would be gone now, 7-8weeks since the accident.

I am still getting about in the Rover but it isn't that nice a car and is dead boring to drive, the tyres are very crap so I have to take round abouts at about 1mph in the wet. To top it all off i slid on the mud outside my house and into a tree putting a nice big dent in the bonnet. I am going to try and beat it out today as the paint isn't damaged. Wish me luck!

So all in all insurance companies are rubbish.
