Reason why Saints Row and Gameplay made EXTREMELY happy!

Here's my story.

I originally pre-ordered Saints Row & Dead Rising from Gameplay on a multi order.

I cancelled my preorder of Dead Rising but kept my preorder of Saints Row.

Delivery day came and they charged me for both games, totaling just over £80.

I phoned up to see what had happened, they said there had been a computer error and i will be refunded.

Saints Row - £39.99 @ preorder
Dead Rising Special Edition - £39.99 @ preorder

Ive just checked my online balance and this is whats happened.

Thank you gameplay for buying Saints Row for me and Paying me £50 to play it :D

(what are the legalities of this? can they take the money back?)

They have paid you the money back for the limted edition of Dead Rising that you had pre-ordered previously, but it's now £50, which is the price in the database.

Indeed, if they realise their mistake they'll request (and get) their money back. I'd be tempted to contact them and explain their mistake, you'd be more likely to get a mini-reward from that than keeping the money with them not noticing.

But sureley the person who issued the refund is responsible, why is it my fault that they gave me too much money back? why should i be the one to pay it back.

Doesn't matter who's fault it is. It's legally their money, therefore they are entitled to get it back through whatever means are necessary.

my mum got paid £400 extra by the inland revenue or some such, now they threatened to take her to court because they overpaid her and she had to do the paperwork to give it back, which she didnt have time for

anyway, they will want it back

They didn't give it to you. They put their money in your account by mistake. That's a concept you need to get your head around. It's not your money even though it's in your account.

But take that attitude with them if you're so sure. I'm sure you'll enjoy the trip to court.

How many times has it been said...

It's not you're money! It was a mistake! It doesn't matter who is at fault, they are within their rights to claim it back if they realise.

Even if they weren't entitled to claim the money back (which they are) - would you really feel comfortable spending money you'd obtained in such a fashion? I wouldn't. If it was me I would contact them and repay it.
