Hi all

Can't be specific but is it legal to make people redundant and then bring in people from India to do those jobs.

Don't quote me on this, but I'm pretty sure the answer is "Yes".

It seems to be happening quite a bit these days, and not just in the UK.
 
I believe that if they are bringing Indian workers into the UK then they have to pay them at the same rate they would do a British worker (which begs the question, why do it?). However no-one does and thus far they've got away with it.
 
If you mean they are bringing in Indians to do the same job here in the UK then it is illegal, if you mean they are exporting the jobs to India then no it isn't illegal.

Can't remember the exact rules, but you can't make someone redundant then immediately hire someone else to fill that role.

They can't make someone redundant unless it is voluntary if the position is still required to be filled.
 
You can dismiss people for incompetence, negative attitude, general distruption, breaking company rulles and long term absences..also misconduct etc.

However reundancy is a non worker inspired dissmissal, so when the workers fullfillemnt is no longer needed.

Someone in my office was leaving, gave 3 months notice. 1 month ago they called him in and said we want to offer you a redundacy package 1 month before he leaves. They said they didnt have enough work for him to do but they had hired someone 1 month ago to do the same job? Such a nice guy.

Its bull****. No?
 
What you're saying is illegal, as I have learnt from The Office :p, when you make someone reduntant you cannot replace them with someone else or the person in question can take legal action.

What it could be is part of an offshoring package, whereby the company in question is bringing people to the UK for a fixed term as part of their training. These people will then return to India to work. This is legal.
 
There is another way around making people redundant and putting someone else in their job.
They give the job a new title and change the job slightly.
