Returning a Console to Store

I bought a 360 Limited Edition Reach Console on the 23rd of September from the purple game store. I want to return it and I have the receipt. It's been used a couple of times, but you couldn't tell.

Am I allowed to return it for a full refund? A few years ago I tried to return something at game saying I simply didn't want it, and they said it had to be faulty for a refund. Basically, if I'd lied I could have had my refund. Should I tell the truth and say I have opened it but no longer want it, or should I say something like it's faulty and I want a full refund?

There's nothing wrong with the console... except my mate says it's running dead slow compared to his and the disc drive went grindy haywire when I was playing Halo. These aren't the reasons i want to return it, I just want to get my money back and upgrade my Graphics Card instead, because I spend most of my limited free time playing FFXIV on the PC :/

Thanks for any advice!

Edit: I bought it in store, in person, not online.

No chance, unless they're feeling particularly generous your only right to return is if the console falls under the sale of goods act (e.g. not fit for purpose/not of satisfactory quality/inherent fault, etc). You don't have a "right" to return something if you simply change your mind, especially since you've now opened and used the product.

Put yourself in their shoes - what are they supposed to do with a perfectly working, but now second hand console?

Even if you say it is faulty, they will take/have all your details on file. The return would be dependant on the fault being present.

GAME are absolute swines when it comes to refunds etc. Best bet would go into the store and try. Make an absolute fuss. They will tell you to go away. Then ring up head office with some story. I bet you they will ring the store and all will be good.

No, you cannot return it because it is used and there is nothing wrong with it. If you claim it is faulty they will test it. Why should they refund you?

They used to have an excellent returns policy but it was stopped as it was abused by people who decided to use them as a free version of a rental company.

Sell your Xbox as second hand, as this is what it is.

As Fox says. The best you'll likely get offered is a Credit Note minus a restocking fee, and that's if you really push it.

Xbox running slow = LOL :D

I work for a high street retailer and this is 100% spot on.

Best bet for a limtited edition one is probably fleabaying it. Bound to be some desperate Halo nut who wants it.

Some parts of Halo Reach on my 360 drop to below 10fps for quite a while :/ On my mates it doesnt drop at all in the same bits.

Anyway, guess I'll just have to sell it on Ebay for 98% of the price I bought it for. Some idiot is bound to pay it.

So If I lie and say there is a fault, which technically there is anyway - just not a big one - I can have a refund? Or are you saying they will not do the refund 'til they've checked the fault?

If theres a fault i.e. its not performing as it should be, they wont give you a refund, they will just send the console for repair or replace it if it cannot be repaired.
The best you can expect is to recoup your money by selling 2nd hand.

On the topic of returning goods, I bought some Beats by Dre headphones the other day, and one of the ear pieces fell off, when I took them back to the store the person told me I was only allowed to exchange them for a different pair. Was I right in thinking that because they were faulty I could get a refund?

They'll test it as you wait and find nothing wrong with it.

Why dont you live with the consequences of your purchasing decisions rather than expecting somebody else to pay for your mistake?

No, they don't have to offer a refund. There are three resolutions to any faulty product most of the time and they almost always go in this order - repair, replacement, refund. If they can't do the first, they offer the second, if they can't do the second they offer the third. You don't get the luxury of picking which of these they offer to you.

Surprised you got that, I would imagine they would tell you to send them off to get them replaced by the manufacturer.
