returning car to dealer after 2 faults

just wanted to update on this.

small claims has been slow, and i mean slow. had to wait for until courts asked for evidence, the buyer sumibtted evidence by the date, seller/dealership did nothing.

date has come and gone, chased courts today, told have to wait another 16 more weeks until can chase courts again for an udpate.

will be a year since purchase by that point. with money tied up on this car, that's sat going mouldy on drive.

still no idea what the outcome will be, though expecting it to go the correct way, as time gets on you worry more and more.

old car is falling apart and needs fixing after fixing.

absolutely crazy.
 
Terrible really, more then within rights to reject and the hassle of all this.

Time to name and shame the dealer I'm afraid.

It's annoying it takes almost a year to resolve through the courts, what happens with money tied up in all of this, it could mean someone's livelyhood!!

I'm buying a car soon and would rather know who to avoid!!!

I didn't realise the thread started back in March, as I was just about to say, good luck with the small claims court, they are VERY slow!

Have personal experience with going through the courts and then the bailiffs. The law might be on your side from reading the legislation, but the law and actual reality are two completely different things.

Say the courts rule in your favour, the garage doesn't give you a refund, the court then say they owe you X amount.....it's down to YOU to enforce it, and good luck with that! I can tell you an enforcement company to avoid if you get that far.

Sounds like it'll go in your favour (or your mates, whatever) but pain in the backside.

It's good to pursue these things though, I've started to realise the more people just give up the more these companies will take advantage.

I feel it's a bit naughty though courts are this slow, that's quite disappointing.

Given the grief of small claims and time involved, think I'd have taken that option.

I know a couple of car dealers. One in particular will not back down irrespective of what is wrong with the car. He'll always try to front it out. Ridiculous really as the last big complaint ended up in court and in the local rag.

Perhaps on reflection,but no way did we expect to be nearly a year later by the time the courts conclude this

I get that completely. Hindsight etc. It took me 6 months to recover a £500 deposit on a credit card. Agreed delivery of an Evo 7 from a very well respected performance car dealers. When the car turned up, it was rusty as hell and not as described. I offered a lower price based on the work required (suspension turrets, bulkhead, rear legs) and dealer said no. They ignored all requests to refund the deposit.

They'll just wind up, and reopen with a slightly different name. With the director using his middle name on company House docs.

Happened to me. Ccj just meant nothing.

The striking off notice is nothing to get excited by about, companies house can do that for anything, late filing of accounts etc, most businesses comply with whatever it is they want them the striking off notice gets discontinued.

All I will say though, looking at the names of the directors, name checks out.....

Secondly why would anyone in thier right mind buy a car from them.

Despite your bad choices good luck in court.

Given how close those cars are parked together on that drive, surely it's a fire hazard? If one of them was to spontaneously combust for no suspicious reason, it looks like they'd all go up.

Their dealership was fine. If it's their origin of country, I can tell you we looked at tones of cars all but 1 from a dealer, and all but 1 of those dealers was the same origin. Endless dealers in this general/west London area are the same.

I'd never buy a car from London, looked at 5 different cars and all were as dodgy as hell, it's just full of chancers, I'm not surprised you've had trouble getting money back.

Almost garuntee they won't turn up to court, and the business will be folded, conveniently it's a limited company so you'll have. No chance of recovering the money.

You might aswell pony up and get the car repaired give it a wash and sell it for something else hopefully better.

Thing is the prices of cars has dropped quite significantly so your car will likely be worth a fair bit less now.
 
Get a chargeback from bank for faulty goods and give it back to them as they now own it again. Then they have to do the chasing and provide evidence it isn't if they disagree.
