Ate you sure though? If my wife was killed because one guy was too chicken to go back into the bank I would personally blame him and try to sure him!

This is pretty silly, but:

You would have no duty of care towards your fellow hostages and there is no general duty to rescue in English law (and even countries that do have it waive the duty if there is physical danger), so you'd have no legal liability (civil or criminal) for refusing to go back in.

The police couldn't force you back in either as they would have no legal power to do so. Any officers who tried could be charged with a few criminal offences and be sued stupid.

Since we're here... What happens if the police arrest you and you don't give them your name/details? (Assuming you aren't reported missing etc...) Do they just hold you indefinitely?
Police can't hold you indefinitely - you have to be charged within 96 hours or released. If you are charged, you'll be refused bail by the courts until you identify yourself. If you never do and are eventually imprisoned, you'll serve the full sentence as you couldn't be released on probation.

What happens if they need the convicts name for the sex offenders register though?

Have you been eating from the bin outside a pharmacy again?

Quite possibily one of the most stupid things ever said on GD, and thats going one hell of a longway.

Almost reminscient of britboy, but not from the same person perspective.

What about if you as a hostage attacked the hostage-takers (i.e. the baddieS) either with blunt force or threatening with a gun - where does the law stand there, can you get away with beating the crap out of someone if you (and others) were in potential danger?

I really don't see why you're thinking about this, maybe you should see a doctor

Where you stand legally?! once you rob a bank and the police show up, you're pretty much ****** I don't see why the hostages even come into it. I highly doubt the police would even consider sending you back in, you'd be arrested, the police would tear gas the place and probably shoot everyone holding a gun.

Job done

Interesting question this. I would imagine due to how messed up the justice system is... If you had the "baddies" life in your hands (i.e. you had a gun on them but they didn't have a gun on you) then it would be a cold blooded murder.

If there was a struggle for the gun and you shot him to prevent him shooting you then i'd imagine that would count as self-defence.

Thanks for this seems to be a good answer. I don't have to worry about going to the bank anymore then :)

The actual question is why while robbing the bank they decide to stop and set a small bin on fire

Not necessarily. If you honestly thought there was an imminent threat to your life, you could potentially shoot them preemptively. Say for example they were leading you into another room with the intention of executing you and you managed to get a weapon by whatever means, then it could be deemed reasonable for you to use deadly force to protect yourself without them having a gun pointed at you etc.
