Sick/Fit Note - None payment of wage

I agree with you for the most part - however, this individual suffers from mental health and depression, but they had also been bullied at work and had raised a grievance. Due to this, they went off sick, not from the pressure of the job, but due to the bullying, which has since been dealt with.

The company will be on even more dodgy ground withholding pay then. If he has a valid Doctors note covering the period they should be paid, handing it to them a day late is inconsequential.

I had to get a retrospective note in September.

GP were terrible. Took a week to get the note.
Was no issue but this could be completely out of the individuals hands

I suspected if the individual persues it they will get thier pay if what's been said in this thread is accurate
 
There really are some messed up companies, or at least HR departments.

I think it is more people in jobs out of their depth. Especially in H/R. If the Employee has it in contractual writing that he is entitled to company sick pay and has provided a sick note from the doctor then he needs to get paid. Irrelevant of when it was handed in he should get back pay and if he needs it there and then he can have it in cash.

They have refused payment and senior management has been involved. But, they too have failed. A dead end and a lesson to be learned it would seem. I feel extremely sorry for the individual.

Nope, not necessarily. Granted if it's only a week of pay then maybe not worth while getting a solicitor involved as that could get into the low thousands... granted an initial consult + letter could be done in the low hundreds perhaps.

ACAS as suggested above and/or Citizens Advice could be worth a shout... and/or "small claims court":


That might trigger a grownup in legal to actually take a look instead of being fobbed off by a HR bint, if there isn't anything in the contract + he met the date they set then some random judge might well be less than impressed with the company being so difficult about it.
