Some advise with an eBay issue please - Not your Usual!!

Hi, I bought a used gaming PC from ebay about a month ago, x4 940, GTX 295, X-fi elite etc very good specs. Anyhow its arrived in a sorry state with the case smashed up, sound card not working, components loose inside and a few bits missing. Anyhow i sent a message to seller complaining who didnt reply. So after a week or so i started a dispute in ebay. In the meantime i sold the PC for £300 as spares or repairs as was in a sorry state and was intented for a gift so needed to recoup some cash prior to christmas so could buy another.

2 weeks later on boxing day i check my inbox and see ive been refunded the full £700 from ebay and is in my Paypal account!! and case closed. Now that ive won out of the blue i get a message from the seller the day ive been refunded that he didnt have internet access etc which is quite a coincidence his internet access returns the day i win case with ebay!! Syas he was in france blahblah, then changed his story to he was cleaning a flooded hotel blah blah and coudnt reply etc. Anyhow hes demanding his money back or the PC back which ive sold at a loss of £400.

If i wass the seller i would be ****ed too but i was out of pocket and now seller is out of pocket. He says hes going to challenge the decision etc and just wanted some advice on where i stand and what to do and if he can challenge decision.

no it doesnt say anywhere i have to return pc. The refund is allready in my account. If they wanted me to return pc they wouldnt have refunded me the money until it was returned? right

Quite so. The seller will want the PC back, as proof to himself, and the courier, that it was damaged in transit. Then he would have been able to claim the damage on the insurance he most probably had.

You now have absolutely zero proof you haven't just ripped him off.

That said, no idea what PayPal would do about this.

You are not entitled to keep it if you have been refunded. You are expected to return it to the seller.

Are you joking? you think that you can get away with keeping it :eek:

I can see you having some kind of comeback here where you will end up giving back the pc or A pc or £700.

It already is dishonest. Buy X for £700, sell it for £300, claim the £700 back. You've made a £300 profit, and the seller has nothing at all anymore.

Did you at least take a photo of the PC and the condition it was in when it arrived?

I tend to agree with you slightly that if they had wanted you to send the PC back, then they would have held off on the refund until the seller had the PC back. I think, despite the fact you sold the PC, you may well be in the clear here.

Out of interest, what was the sellers feedback score like? Was he a store or just somebody flogging a PC?

I didnt claim back £700. I just made a dispute not expecting anything really from ebay. Was shocked infact when i was refunded. Thats why im asking for advice so please dont call me dishonest.

I'm an eBay seller myself, do a little bit on the side, nothing exciting, and while I do feel the seller in this case, there is one glaring issue that comes to mind... Why the heck didnt he get back to you to resolve this issue. Yes, it seems like he is now going to get 'the shaft' but if he'd acted properly and tried to resolve the issue instead of putting both fingers in his ears and hoping you'd go away, maybe he wouldn't find himself in this position now.

Its been well over a months now so he couldnt claim back from parcelforce as you have to claim within 30 day. Seller didnt respond to any my messages over a 30 day period so the claimimg part is his fault. If he had replied i wouldnt have sold pc. I thought i was being shafted so sold pc to cut my losses, wasnt really expecting ebay to be of much help

This isn't much help, but if I was the seller I'd feel like I had just been scammed...

Surely the seller can open a dispute and get his £700 back, after all, the OP has no proof whatsoever as to the PCs condition and without that proof this reads as a classic eBay scam - buy something, raise a dispute, get money back whilst keeping product.

I understand (I am hoping!!) this wasn't the case in this instance; just pointing out the other side to this.

What givers you the right to steal a computer. That is what you have done. Stolen it. I hope the seller gets the police involved.

Re-refund the £700 and realise you have done a very silly thing. He can't even claim of RM or the courier who broke the thing in the first place...

Sorry what. You should have waited until you heard what the outcome of your complaint was before selling the goods. The seller has every right to ask for the goods that you claim were faulty or in poor condition. As others have said at least this way he could claim against his postal insurance with the proof of damage.

Not sure if others agree but as a minimum you should explain your story to the seller and offer him at least the money you have made in profit as a token gesture. Personally I still feel that isn’t enough but at least you are helping him to get something back instead of the nothing you are currently offering him. Also I have no idea what the come backs could be on this.

why are you calling me disgusting and accusing me of stealing a computer?? i opened a dispute for damage and bits missing, seller didnt reply. Not once did i ask or expect to be refunded all the payment.

wonder if any of the above actually have been in this position. I have.

We purchased an item, it arrived and was unusable. Seller wouldn't refund or accept item back.
Paypal ruled in our favour, gave us a refund. We questioned what to do with item, they told us its up to us!

The item wasn't 700 mind (just under 200).

I think i better have a chat with seller, because i dont want any tainted money. All i was asking for was some advice etc not to be called disgusting and a thief by AcidHell, thats not on.
