Some advise with an eBay issue please - Not your Usual!!

Yup I see craterloads has hidden his feedback now, tbh mate that makes the situation even worse from the POV of someone that you've willingly ripped off.

As you stated multiple time you weren't expecting the refund you'd be no more out of pocket than you thought you would be if you refund the seller.

It's entirely your own fault for apparantly "selling" the item for spares before any form of contact with the seller.

You HAD his pc, you then sold his pc.
You HAD paid him, you then took the money back.

Do you have any form of proof of the extent of the damage that you're claiming?

Yes the paypal will have auto closed the dispute if no response from seller, he claimed he was away which is why he didnt respond Im guessing. I know for a fact if someone disputes this amount of cash it's somethign you respond to striaght away ;)

I hope the guy registers on here tbh, as many have said you have the guys PC, his cash and + £300. Splitting £300 is tbh an atrocious offer to make to him, you have no entitlement to any of it until you've paid the guys back the 700 you've stolen from him tbh.

Hope someones saved this thread before op goes and changes all his posts :p

The OP has acted like an absolute muppet. I wonder if he actually understands how buying/selling items and refunds actually works? I don't think the OP see's it like that, I think he see's it as "I've profited!!" without actually seeing/understanding it from the seller's point of view.

This attitude, whether done through ignorance or malice, is one of the reasons why I rarely sell items on eBay now. Too many muppets who are all "me, me, me!!".

is it possible paypal re-open the case once the seller came back from alive?

is there any deadline for seller/buyer to be response?

This is a troll, ebay/paypal will not refund the buyer untill they have sent the item back recorded/signed for.

But then again this is ebay/paypal...
 
Yes you should have returned it. The seller is out of pocket for whatever reason. May not be his fault as couriers are terrible at handling things, especially if you write fragile on them, they think that means 'throw about'

You should have returned the PC to him, common sense must tell you that. You have a refund. Plus £300 and he has nothing now. Not even the damaged PC back so he could sort it out.

If I was him and I get no money back from paypal/ebay or you, then small claims would be my route to go. Or a visit to see you in person and get my money back.

Also where is your proof apart from your word that it was damaged? you dont have it now so you cannot proove anything.

I now think you are deep in it.

People have other lifes outside of the internet. Sometimes I can be on the internet everyday and sometimes I cannot get on for a week. So his story about not being able to get on the internet maybe true.

Op to be perfectly honest, if they seller is a privvy to his/her rights, he will take you to a small claims court and you more than likely lose the £700 and maybe a bit more. 'cos i believe (im no expert but i had small experience in Small claims courts) he will win because you stupidly sold on the computer, and have no proof it was sent out damaged, why you did that i'll never know.

but on the other hand, why did Paypal just refund without asking for the machine to be sent back to seller, maybe the seller actually was out of contact and didn't reply to the dispute, changing his story hasn't helped and who's to say he actually sent it out in a good condition anyway, either way 'cos you sold it on without any proof and not waiting for the resolution to the dispute, you don't have a leg to stand on im afraid.

I recently bought an 8800gts from ebay, it arrived dead (will it was glitching like hell down one side, been overclocker/cooked), seller didn't respond, refunded and i kept the dead card (for all the damn use it was!).

Bought a 4650 from MM after that :)
 
Ok, the seller should have got back to you quicker then took up a dispute with the parcel people, but I would have sold the pc on after only a week.

I didn't read the full thread, did the seller get some money back?
 
I've kind of been in the situation.
I sold a 4870x2 to some guy on Ebay for 170 pound.
A month later he claims it's broken and is demanding a refund, I offered to RMA the card for him, but he refused to send it to me and was threatening me with paypal dispute, I closed my PP account to cover myself, he then filed a dispute and PP refunded him his money, while not touching me, he then returned the card and I RMA'ed it and resold it for 180 pound (It was still in shrink wrap).
I profited 180 pound, the buyer got his money back, and someone got a brand new 4870x2 for 180 pound, so.. Nobody but PP lost LOL.

And you will never be able to open a PayPal account again....Nice work!
This buyer protection thing is ruining eBay and PayPal.
