grrr this is so frustrating
i did have the sound working - but not the nvidia grapcs drivers
so i reinstalled the restricted linux kernal
RESULT
Nvidia Graphics work
Nvidia sound stops working!!
so i try reinstalling the audio drivers and get thsi:

i then went into synaptic and installed linux-source 2.6.15.23.35 (to go with my 2.6.15-23-k7 kernal - is that ok?
