Speeding Prosecution

Can any of you guys tell me what the penalty will be for the following:
My son aged 26 has ben prosecuted abd due to appear in court after being caught by police doing 108mph on A14 (dual carriageway with limit of 70mph)
He has a 3 point statutary fine already on his licence. Will he be offered option of 6 points or ban. How long would ban be for. He needs car for work as he works 80 miles from home.
Any help or advice on plea or anything else would be appreciated. For the record as his father I am disgusted and have no time for him, I am just worried for his job.
 
I believe they can fine you a lot more instead of ban if a car is essential for work. Although I would guess this would normally be for work traveling (e.g. sales) rather than commuting?
 
He might not get a ban if he can show that he will loose his job, assuming he cant just get a train or something.

He was going rather fast so the possible ban is looking very likely i would say. Anything over 100mph is ban territory usually unless you can convince the magistrate that to ban you would cause extreme suffering or hardship. If your son has no dependants then they may say "tuff luck" about him losing his job.

If he has kids and a wife to support then it may go in his favor and not get a ban.

If he had been doing about 90mph then, with a clear road and a lenient magistrate he may be considered to have been speedy but not reckless, 108mph however means they will see him has having his foot down and not caring about the consequences. If he loses his job he will maybe learn his lesson, is how they may see it.

Its very much a ban he is going to get, may get lucky with the judge if he pleads a strong case about the job situation etc......but seeing how he has 3 points already, they may come down hard on him.
 
My advice would be head over to this place http://www.pepipoo.com/ and do some research. If he has a good legal brief there may be ways to get out of a ban if his car is needed for his job, and simply getting to and from work may not be enough. I would suspect 28 day ban and a fine so I suggest your son does not take any more holiday allowance just now...
 
Does he have a house or kid, might swing in his favour about not getting banned but people should think about there licence and job before they go 40mph over the speed limit.
 
I sneeze and I am doing 120mph. I have no idea what car the OP's son drives but people should not forget that though we all know its wrong to speed we all do it and though 100mph plus may seem a lot, for it is, getting there in a fast car is a work of a second where as to many it might be the work of 2 miles, a hill and a deep breath. Of course it does not make it right but in some cars it can be very easy to hit 3 figures which of course means all the more will power is needed..

People that need their car for work should really be a little more careful.

The word "need" is also the crux of it as well. Someone may think they need a car for work as its 3 hours on the train, a magistrate will just say "get up earlier then".

Im self employed and have to go to people's houses as well a business's and some days it can be 3 or 4 all over the place. I simply could not use public transport to do this as well as carry all my equipment with me... hence i NEED a car to do my job, rather than make my commute a bit more comfortable and easier.

If he can use a train and busses, even if it adds 4 hours to his day, then the ban-hammer looks very likely.
 
108mph = ban iirc.

A friend has just been done for doing between 100-120mph over 5 miles or so on a motorway. He just received a 4 month ban and got a reduced fine of £360 (from £680) inc. costs etc. He got a reduced fine as he apparently showed remorse whilst giving a speech in court - he said he was glad it didn't end up in an accident and worse etc. He also had no previous points. He also put in an early guilty plea by post.

He didn't get a solicitor and probably should have as I've been looking at different cases and it's not air tight what you'll get. Depends on magistrate etc, policemans report (his didn't sound too good apparently except they gave him credit for pulling straight over and being polite) and the fine should be means tested but may be reduced if you show remorse etc.

Needing a car for your job doesn't buy you anything in court, They don't care as you should have thought of that before speeding.

Best thing I can advice is to come up with some "Extreme Hardships". These are the only things that will make any difference really. You have to give these under oath in court. If you can proove you have extreme hardships i.e. a disable parent who relies on you diriving, elderly grandparent who needs to be taken shopping/hospital every week and a whole host of other things then you may get away without a ban but a increased fine. My friend had no extreme hardships to say about and just bent over and took what they were giving him. Ouch!
 
Yeah what it's with the A14 at the moment, it seems to be popping up everywhere as being a 'bad' road...

Lots of crashes mate, I've stopped using the M11 / A14 route out of London these days, even at night, chances are some "incident" on the A14 screws you over.

Also, its a fast road with lots of little side roads leading onto it, many un-signed.

A Slow vehicle pulls out into the path of Mr 108MPH and you can imagine the rest.:(
 
Anyone know. If you get a ban, say 2 months. Can / do you also pick up 6 points as well. i ask this because if he then picked up 3 points in 2 years time he would get banned again on the tottin up to 12 points rule.
 
No certain answer. Big fine and some points if lucky, ban and big fine if not. If he gets a ban then I believe his points will go back to zero.
 
This drives me insane - get nicked, get banned. End of. None of this crap 'Well I'm a printer fixer with a van I'll lose my job', why should they be allowed to continue to enjoy driving whilst a guy who works in an office gets his enjoyment taken from him just due to career choice?

It's pathetic. If you rely on your license for your job, be more careful.

And no, thats not holier than thou, I've had points before as well :p
 
People don't value there licence until its gone, I got stopped for speeding and let off and it made me think, do I need to speed unnecessary or do I want to risk me lovely licence.
 
What do you mean he will have the option of either 6 points or a ban? I would have thought this to be an automatic ban no matter what the circumstances. - 12 months for sure but could easily be 18 - Seen it been given out in the past for something similar.
If he is able to accept 6 points why would he even consider any other option, at least he will be able to keep his license. A ban, I suspect, would mean that he would either have to find another job or move closer to his existing one.
