Speeding ticket

the threshold (i think) is in that there is some tolerance for ther gun error.

I.e. if your ticket says 34 you were probably doing 38 on the clock.

I was doing 34 (on my speedo) when i saw the camera van, i was 100% convinced i would get a ticket! nothing came, it must have read 30 on the camera! or pretty damn near

dfarrall is right, there is no THRESHOLD, only GUIDANCE.

People also need to distinguish between the speed that the police gun shows (basically your accurate speed) and the speed your in-car speedo shows.

If the limit is 30, then the police can charge you if their speed gun shows you as doing 31 mph. However, they have GUIDLINES which usually state to only charge when their speed gun shows you as roughly +10% (ie >33). This is partly to account for any error in the speed gun, where if you're only just marginally over the limit, then they have to prove that their gun is sufficiently accurate to measure within 1mph accurately.

However, your in-car speedo is always set to over read. That is that when the police gun shows you as doing 31mph (your actual accurate speed), then your in-car speedo will have shown you as doing more (eg 33mph).

So to get done doing 34mph in a 30mph zone, it is likely his speedo read closer to 35-37mph at the time, which isn't exactly 'harsh'.

Not always true; it should be within 0 to +10% of your real speed. Many cars show the true speed - my old 330i did for some reason.

When a car leaves the factory it must read accurate at 30mph. But that is the only time its checked and calibrated. Anything above that speed the speedo is allowed to over read but never under read.

Getting done for 34 in a 30? That's really harsh. But by my understanding, if the date written on the ticket is more than 2 weeks after the alleged offence, then it's invalid.

Why are people giving incorrect advice??

You were verbally nipped at the roadside, you have then 6 months for the letter to come through.

You don't need any receipt after he pulled you.

Getting your first name wrong does not matter

Pay fine, move on. Harsh for given speed but limit is the limit

My s2000 is dead on exact. It's definitely the error factor of the gun as to why peoplethink they get off . Although yes my seat analogue gauge reads above my real speed

there is no threshold
I got 3 points for doing 53mph in a 50mph zone a few years ago
I switched my licence to an iom one a few weeks after getting the points so i had zero points straight away

Police can pull you at 31

HMO/ACPO guidelines for the safety camera partnership are 10%+2mph or 2mph+10% cant remember which way round. Its all to do with guaranteeing a conviction

Good old PooPeePlops: look at the date on the doc:

ACPO

7 July 2000

ACPO tore up those guidelines over five years ago, and it is up to local forces to make their own decision. The limit is 30, and any speed over that, including 30.0000001mph is breaking the law. Forces may choose to look the other way up to a higher figure, but if you exceed the 30mph limit by 1mph then they can prosecute if they wish. They could before as well of course - that's why ACPO use the word "guideline". Oh - and the force doesn't get the money either, before someone pulls that one as well.

As for the OP: write back to the court and ask them what is going on. Send any letter by Rec Del.

Of course it matters. The NIP is not adressed to him.

Or if his name was incorrect on his licence would that not matter either?

It's not a nip. He was verbally nipped at the roadside. Yes they could argue an incorrect name in court but it won't change a thing!?

Trust me ;)

You are all missing the point, who cares about thresholds?

The fact his, they have got his NAME & ADDRESS wrong imo I think you are going to get away with it.

Hardly - the only bit which needs to be right first time is the reg number. For everything else, look up "Additional Statement".

That is not a get out of jail free card. Assuming you were given a NIP at the roadside, they can still correct the error.

How.......................has he got the letter then?

That is a good question though.
