SSD drive failed and concerns over return...

In a moment of madness, or it could be just coincidence, I upgraded the firmware of my SSD a week or so ago. The drive is just less than a year old and had worked flawlessly.
Using S3 sleep I then tried to wake it and was greeted by a BSOD. Trying to reboot the PC and the BIOS would not find the drive. Left it off for a few hours (like noted in the OCZ forums) and it still will not be detected in any of my PC's.
So I now have a rather light paper weight and this is the point of my concern...

The SSD was my boot drive and thankfully the "My Docs" and photos etc were all on my other HD but whilst there is nothing "dodgy" at all on the drive it still has all my bookmarks and some websites were set through Firefox to automatically login in etc. As I can't get access to the drive at all my only option is to return it as it is if I want it dealt with under the warranty.
For those who have had to send a drive in under warranty, which has totally died in such a way, have you had any concerns over the data on it and can you be reasonably sure that if the drive can be accessed that it would be wiped by the company rather than looked at..? Ultimately if I was that worried I would write off the drive but it is more of just being concerned.

As a side note I was surprised at how many similar posts there are in the OCZ forums about their SSD drives failing in the same way as mine. Whilst I know that all drives can fail it just dismays me as I expected the SSD to be more reliable than a mechanical drive and if it did stop working it would then be in a "read" state only.?
