I went to work when i had Kidney Stones, went to the Doc's at Dinner and was rushed to Hospital was in overnight Left Hospital at Midday ish and was back at work the same day......

OP, print out the SC2 from the above link and the relevant page of guidance saying you can self-certificate for 7 calendar days. Deliver both to your HR department with a note saying you're happy to fill out any of their personal departmental self-certification forms, but you won't be providing medical confirmation.
 
Then tell them to 'do one' and stop bothering you.

Ok, this is making more sense now. However I cant seem to find anywhere that says less than 7 working days. HR seem to think it's 7 calendar days, which seems like a load of crap, however I need this written somewhere to show them otherwise. Even the above quote doesn't explicitly say '7 working' days. :confused:
 
A couple of weeks ago I was off sick for a working week (5 days) with the flu, or something similar anyway. Upon returning back to work, HR called me in for a chat to check that everything was ok, and asked me for my doctors note. Naturally I didn't have one as wtf is the point in going to the doctors for a simple virus. HR requested that I still provide one, so I popped to the docs last night, explained that I was off work for a week and was told that I can fill in a self certification form.

I've just been to HR to explain this, and they've told me that as I was off for 7 calendar days (including the weekend) then I still need to provide one.

Can anyone help with this? It seems like a massive waste of time to me.

You can certify yourself for the first 7 days of sickness. You need not supply a doctors Fit Note until this time....this runs from the day of notification of sickness, until your notification of your return to work.

This is not 7 working days, it is 7 calendar days....so if you informed them on monday morning of your illness and were off for the rest of the working week assuming a mon-fri working week, and you informed them on Fri of your intent to return on monday (you normally do not work on sat/sun) that is 5 days sickness.....however if you inform them on monday, or simply return to work on monday then that is 7 days sickness and is still covered by SC rules....if you informed them the preceding sat and returned or informed on the following mon that is 9 days sick and so you woukd need a doctors note for the last two days......

The seven days include days that you don’t normally work. So when you work out how long you’ve been off sick, you should include weekends and bank holidays.

You must have told them you were sick on Monday which is the start of the 7 day period.

These poeple are just dumb!

On a similar note, before I dig out a copy of my contract when I get home, does anyone know if completing the Employee's Statement Of Sickness form (SC2) will affect my pay for the week?

You have to fill it out anyway for any period of sickness of 4 or more days.

Whether it affects your pay depends on your companies sick pay rules, minimum they have to pay you SSP, although there is a waiting period of 3 days to which you do not get SSP. So if you were sick mon-fri....you would get SSP for Thurs and Fri.....however unlike self certification rules this only applies to working days.

I've just had the HR intern provide me with a copy of my contract. :p

"You will be paid in full for up to 10 days sickness in any 12 months".

So, I'll fill in the self certification form, get paid in full anyway, and HR can go **** themselves for wasting my time.

Correct, and you wouldn't get paid for the Mon-Weds period. It depends on your company policy though, they might waiver this.

The 7 calendar days is more for over the weekend type sickies I believe. For instance sick wed, thurs, fri, weekend, monday tuesday. That is 5 working but 7 calendar, if you were off the second weeks wed as week THEN you would need a note.

I've just sent an email to HR detailing all of this. I have a feeling I'll hear nothing back...
