Rainmaker, your belief matches what I have read on Consumer Action Group, and the other anti parking charge website whose name I forget. The words penalty charge are reserved for official use and it is against the rules/guidelines for parking companies to use the terms. I think it may be something to do with how they are not permitted to charge a "penalty" or to be punitive. The invoices are based on contract law so they are suing for damages so a "penalty charge" is by their own admission punitive.
There are even rules for councils, which many of them still aren't adhering to apparently. If the council doesn't follow all the rules about what is on the parking ticket then, assuming you have the balls, you can appeal (which will be probably be refused because councils hate when you challenge their authority) and then take it to a tribunal and win.
