At the risk of being anal people keep saying 40% discount but if I've understood correctly it is effectively 36% discount, not 40%.

This sounds like a big retailer and there is no way they have a 20% discount card scheme without very tight rules on use one or more our OP will have fallen foul of. (the company is big enough they tracked the evidence).

Your solicitor friend must know this but being a solicitor (ie a ****) he will not have mentioned this.

However you do not know if the company have rules set in stone and a Solicitor will want the evidence. A case of 'Everybody knows' will not do.
The Solicitor colleague is a lady, in fact both the Solicitors I work for are female.

he says theres nothing in the guidelines to stop him doing what he has done , if thats right then hes got nothing to worry about. even if it is a bit dodgy!

Where I work the is nothing in the guidelines that specifically states I cannot take float money out to buy milk then use it to buy myself cigarettes, should I try it? >.>

According to the HR Director here (a qualified employment solicitor) that is not true...common practice can and does form part of the expectations of a workforce. Also, in this case even if there is no explicit statement in the handbook it is still a reasonable expectation that the discount privileges are not abused in this way.
 
I am fairly stunned so many people think this is in some way a grey area.

It quite clearly is an abuse and at very least shows dishonesty and imo is straight fraud not so very different from stealing money straight from the till.

Would love to know the company as in general it is very easy to find out the T&Cs of most big retailers staff card schemes but as has been stated do you really think you need an explicit rule to say do not abuse this ?

Eh I wouldn't call it a grey area but who reads all through terms and conditions and takes it all onboard? while I find it hard to believe someone would do it as a semi regular thing without realising I can see how someone could accidentally do it now and again if there aren't safeguards in place.
 
lol there is a difference between doing it once accidentally and 10 or so times over a year.

I do not buy the ignorance stance over such a period of time.

Indeed all contracts will have implied terms of which not abusing staff discount would be one.
 
20% off gift card....... 20% off purchase price (including gift card) = 40%.

You buy a £10 card with discount, you pay £8, you then use that card to buy £12.50 worth of stuff (costing £10 with discount), you have paid £8 for items worth £12.50, that's 36% off.

It's 20% off the 80% remainder after the first 20% discount. It's diminishing returns, so 36% off.

0.8*0.8=0.64
*100 = 64%

100-64 = 36%

It's not even GCSE level maths...

Yeah so 20% off the gift card then 20% of the already effectively discounted price.

You don't get 40% off because the second discount is off an already discounted price.
