No, no -- don't get me wrong... I don't agree with his actions. It's obvious from his original post that he does feel guilty -- because he knows what he was doing is dodgy.

However, in framing his defence, if he wants to keep his job, then what I have said is going to need to be his argument.

When the company allows it, there's no room for moral posturing with his job on the line.

exactly just like the shop with the gap in the CCTV coverage is entirely to blame for me stealing that flat screen tv.

That's just ridiculous, and completely irrelevant to the situation.
 
There should be some kind of safeguard or prompt IMO not everyone digests the T&C in detail and/or thinks logically through everything they do i.e. you could go buy a giftcard for a present then later find the perfect present and give that instead then later on decide to use the giftcard up seeing as you have it and go through the motions as you normally do giving your staff discount (or as often happens if the member of staff on the till knows your staff they just put it through anyway) and end up getting discount twice.

As something that might happen occasionally I can see how it is possible to do it innocently I'm less convinced someone wouldn't realise if they were doing it semi regularly however.

yet he was buying giftcards to use for himself to buy things for him personally not just gifts.
 
he states they were friends and family not himself... but that does sound really dodgy.

There is still some burden of proof on him to show that he was told he can buy gift cards on discount, but then the rest of the burden lies with the company to prove there is something to say they can not double up that predates the first instance. If they can't do that then at tribunal, if it goes that far, it will be a sticky situation for them.

even if they don't cover this specific scenario they'll have it in writing that staff are entitled to a 20% discount

his manager asked him to confirm that he knew what the staff discount rate was

he helped himself to a 36% discount because of a flaw in the system
 
Good point didn't think of it like that, even if it is two separate transactions with a few days between the resulting discount is still 36%.

I doubt we will ever find out the result any way as he has not posted since.
 
According to the HR Director here (a qualified employment solicitor) that is not true...common practice can and does form part of the expectations of a workforce. Also, in this case even if there is no explicit statement in the handbook it is still a reasonable expectation that the discount privileges are not abused in this way.

That's why they are Solicitors.
 
little lame by the company in the first place, i know a lot of retailers that exclude as a gimmie

booze
ciggys
gift cards of any type (instore, itunes blah blah)

although i think you knew what you were doing was wrong the company did allow you to buy a gift card with 20% off, and then you are allowed to do as you please with that card,

... the issue is when you used the gift card you then had the choice to say "hold the discount" - that is the issue

I also don't buy the "forgot what i purchased last week" you saying that to a boss is dumb move, just going to raise suspicion.

I have been with the company nearly two years have never had any warnings etc. had my first ill day last month since I’ve worked for the company, have only had good appraisals and the current manager suggested that I should apply for the supervisor training programme at my last appraisal.

All of which means jack in life I'm afraid....especially retail life.
