Clutch failed after 1700 miles?

Sorry but I would have requested a refund at that point under the sale of goods act, the fault was clearly preexisting.

Funny you should say this. I enquired about buying a new Fiesta ST from Evans Halshaw. Everyone I spoke to sounded disinterested and when i finally got a response to my emails, the sales woman i was dealing with could hardly compose a decent sentence. I honestly found it hard understanding the garbage she was writing.

Needless to say i went and bought one elsewhere....
 
Clutch went at 17000 miles and VX only warranty them for 18000 miles.

My first and last VX I can say and Pentagon are cowboys.. Even VX customer care are useless... lots of phone calls and not much else. A lot of the problems have been caused by the garage themselves. Whenever it went in for repair I would get it back with something else faulty.

I do wonder just how badly a car has to be treated so suffer a list so long at so few miles


that said I wonder if something is out of true on the bottom end seems to be largely items that would be fouled up by something being out of whack, timing clutch box etc
 
17000. But then a clutch can wear out as early as that depending on how the car has been driven previously.

No he bought it with 15800 miles on the clock, 1700 miles later clutch fails.

It should be expected to last longer than that, and given it was within 6 months of sale the onus is on them to prove the fault wasn't there already.
 
If they've offered £6k ex. VAT say that you'll take £6k+VAT and they can claim it back. Although if the offer was made in October and you've now had the car over 6 months, one would imagine it is no longer on the table.

Naughty. You only pay VAT once. When the original purchaser buys the car, the VAT is passed on to HMRC through the dealer. There is no VAT on used goods.

Small claims is a very good service. Definitely pursue this as they'll not want to go to court. My guess is they'll settle but you have had use of the car so you can't expect all the money back unless you ask for damages to compensate for your inconvenience.

Whatever you ask for, think what is reasonable.

The £6600 option sounds about right.

Do bear in mind though that even when you get the judgement they don't necessarily pay up. I have a CCJ against the operators of the store that funds these very forums, but they didn't pay up.

I have treated the car with mechanical sympathy since I purchased it. I got a bank loan over 5 years to fund the purchase and I expected to keep the car for at least the 5 years, more hopefully. I intended to service the car before the recommended times as I rely on a car for work otherwise I would do without..

Pentagon also fiddled the paperwork, I purchased the car 3rd Aug and collected the car on 15th Aug but the V5 arrived showing I became the legal owner on 31st July.. Apperantly most garages do this a solicitor said.
