The nervous wait to exchange....

All my solicitor has done now is email the generic mailbox of the local council. Yeah like that is going to get answered quickly. Pick up the phone and call the senior members of council and get this info !!!!!!!!!
 
Are you near a motorway that was upgraded to smart motorways? We had the option to pursue a claim but never did.
 
nope, ex council estate, bog standard drive/road stuff. it's just the fact there is no info from the search and no council person seems to be able to find anything on it.

can anyone also advise if planning permission document required for a single story extension when building regs/application and completion sign off from council are provided. This also seems to be a massive sticking point with the buyers solicitors.

  • Single-storey rear extensions cannot extend beyond the rear wall of the original house* by more than four metres if a detached house; or more than three metres for any other house.
  • Where not on Article 2(3) designated land* or a Site of Special Scientific Interest; and subject to ‘prior approval’, the limit for single-storey rear extensions is increased to eight metres if a detached house; or six metres for any other house.
    This requires that the relevant Local Planning Authority is informed of the proposed work via a prior approval application.
  • Single-storey rear extensions cannot exceed four metres in height.

So they didn’t get planning permission for the extension?

If it’s less than 4m high and 4m depth then they may have been able to do the work under permitted development but will of course need to supply building regulation sign off and FENSA certificates.

If these aren’t in place (the FENSA side of things you can take a view on) then I would walk away.

No amount of indemnity insurance would satisfy me that the works had been done to a satisfactory standard - only building regs sign off - and even that isn’t a golden stamp

If the extension is more than 4 years old then planning cannot be enforced against it (it is 10 yrs in some circumstances but normally 4). A solicitor will probably still suggest an indemnity policy though, but it is your choice whether to accept that (unless your mortgage company demand it).

the extension is 2.99m from the existing building on the rear so looks to me like planning permission wasn't required. I have the building regs paperwork and council completion sign off but there was no FENSA certificate when i bought the place so I have an indemnity in place for Fensa.

None of this came up before when I purchased the house, so the previous solicitor I had was either useless or the buyers solicitor is a stickler for paperwork.

Will give them a call tomorrow to double check but any advice?

I did my own windows so was told to get indemnity. I went privately and it was about 150 quid. 100 of that was broker charges. Lmk if you want a link
 
exchange for me on the 24th and complete on the 3rd. been a long 6 month process for a new build (already built) property

can finally get everything organised and start planning.

thinking of a video doorbell/single camera at the rear setup so thats now on my list of things to investigate. 1gb up/1gb down hyperoptic broadband ordered as its plumbed in already.
 
Still no news, just one seriously annoyed cat. This process is ridiculous, completely invisible to it all bar some emails that are about as useful as chocolatw teapots for real facts. Only 2 below and my purchase that's 4 in total. Should be 1hr each max. Absolute madness.
 
I remember one of my moves where i was only able to get the keys at 5pm. Just as the agent was closing as that is when the money was finally in the bank!
