It doesn't seem to be the case, both the police and courts take accusations of 'transphobia' extremely severely. It is also protected by all the hate speech laws we have.

Short of hate speech laws being changed, there is nothing much that can be done to prevent frivolous legal suits over calling someone the wrong gender, and this has already been going on for many years now.

problem is that this kind of celebrity publicity about non-binary,
all gives credence to the likes of the publicized UK clinic and its's pathway, for medically transitioning children, so - not harmless.
I doubt social media will label her/their/pronouns, innocuous announcement, as adult only.
 
The solution is to tell people to look between their legs to confirm which toilet they should be using.
To be fair that could get confusing for fellow occupants these days. I do have sympathy for people who are genuinely going through or have completed a transition and are living as their desired sex, just not the ones changing their gender every 10 minutes or being "unclassified" just so they can feel special.

I mean this is a valid thing that I don't get why its never mentioned regarding this topic.

The purpose and use of toilets its based on where a person excretes from, not how they look or what they think they are in their head.
