Totally Random Hypothetical...

Afternoon all :)

A totally random question popped into my head this morning on the way to work - And I wondered if anyone here had experienced something like it, or knew what would happen in this scenario.

There are so many people these days that I see going around roundabouts without using their turn signal - This is a hypothetical question and hasn't happened to me or anyone else I know - but was just curious...

Imagine you are on a three-way roundabout, with a car coming from the other side that wasn't using their signal and they were going right around the roundabout. You pull out and crash into them because you assumed they were going straight over as they didn't use their signal...

Assuming you had a dash cam and could prove that they weren't using their turn signal as they should, would you be able to prove that the other car was at fault?

I understand there's a lot of variables in this - But I just wondered if I end up crashing into someone that isn't using their indicator, in any scenario, not just a roundabout, would I be liable to pickup the damage costs?

Any thoughts? :p

I'd say you'd still be at fault. You should wait until it's clear to go (taking into account traffic that hasn't signalled) before entering the roundabout.
 
Or possibly even 50:50, i think it'd be hard to prove the other drivers 'bad driving habits' were solely at fault for the crash.

Haha :p I swear this was a hypothetical - And I always wait and make sure they aren't going somewhere they aren't indicating too :p

But I see so many people driving and not using their indicators - I was even in my mates car yesterday and he was a serial offender :p
 
A flashing indicator just proves it works, that's some advice my riding instructor gave me and it's kept me in one piece so far.
 
I was told by Admiral about 10 years ago when a lady swerved in to my lane on a roundabout and hit my wheel arch that without a witness or some sort of evidence, the vast majority of accidents on a roundabout will be a 50/50 fault claim. Which seemed ludicrous at the time but makes perfect sense now. I know from experience, never to assume peoples actions on a roundabout, and doing so means you're as much at fault as they are, unfortunately

Heh, that's a good motto to remember.

If you're in doubt about someone's actions on a roundabout, just wait or hang back. Yes, the Audi behind you might blast his horn but it's better to be a little hesitant than go in all guns blazing Youtube Dashcammer style, causing an accident.
 
I'd like to see a function added to cars where it monitors how much you're steering and if you used indicators, if it determines you turned without indicating the computer screams "w*nker" at you in a loud voice.
 
If they were going round the roundabout 5 times they would not need to use their indicator either, it'd be like indicating to turn off a main road, so would be 100% the fault of the person pulling onto the roundabout.
 
Around here people seem to use any lane for any exit. Most of my near misses on roundabouts are people in the right hand lane for right turn only, suddenly going straight over.

You can predict most of them and in flowing traffic its not that much of a deal, but when entering the roundabout from stationary you can be almost beside them when they cut across.

There's also a roundabout with just left and right but people still go left from the right hand lane.
 
i'd have thought it's 100% your fault as you were entering the roundabout without it being safe to do so.
whether or not the car on the roundabout indicated is irrelevant.
 
Many many moons ago my brother got a driving without due care and attention charge when he pulled onto a main road and the woman who was indicating to turn drove straight into the side of him, police at the time said it's irrespective of her indicating, you pulled into her right of way so should always wait.

That has stuck with me and even when people are indicating I wait until I know for sure they are turning before pulling out.
