Bit of a weird one, got contacted by moorcroft group and spoke on behalf of my partner because she is unable to.

They have just been sold a EE debt from 2008, now that's an awful long time and EE wasn't even established until 2 years after so I assume it was from orange. She has been an EE customer with no other issues so It sounds to me like a shot in the dark to get payments?

I did double check the number calling wasn't fake end requested a copy of the bill in case it's been rolling over for years unknown to her. Is there anything else I can do to sort this?

Statue of limitations applies - debts over six years that aren't acknowledged can't be collected, they are just trying it on. Do *nothing* to admit liability for the debt or even acknowledge it was hers - this resets the clock.

I can't acknowledge its hers anyways as I said to the collection agent I'm responsible for her finances and ensure she doesn't pay out her disability to debts that aren't hers. I hope the bill will clear it up

I thought debts were written off after 6 years

I really hope so, I'd be awfully surprised if the contract was continually rolling since 2008 especially with her being on pay as you go for 2 years and it's not related to her previous contract. I would wonder what the legalities of rolling over for over a decade would be aswell it's not even a huge amount just over £200 nothing makes sense with this one.

Just realised the date the contract was supposedly taken out she wouldn't have even been 18 :/

If it's only recently been sold on and the amount is that low they're just chancing it with the panicky types who pay up right away.

They are fishing.

Do not admit you own the debt, as this could restarted it, 6 years statutory barred there is nothing they can do.

If they call you again respond with I"do not know about any debt and please do not contact me as you are making an unsolicited called and if you call again I will inform the police and take out a pin notice against your firm regarding harassment, could you delete my information".

They will never call you again.

out of curiosity would the op be willing to give a rough figure of how much the debt is?

He did:

A debt is never written off (unless its a bankruptcy/debt relief order) what is more likely to happen is a 3rd party company bought the debt for a penny per pound for example.

So a £1000 debt cost them £10, they then chance it by contacting the original debtor saying, hey look if you pay £500 we will accept it and consider it gone. Person pays up, they make a tidy profit, person ignores the requests, they lose a tenner or write back a few months later and say hey, if you pay £100 we will consider it done and dusted etc etc.

I'd get a copy of her credit search, go onto Experian, you might have to pay a couple of quid and check there isn't anything registered there.

We have something similar a few years back. Contacted out of the blue about a debt which we knew nothing about. ignored it. A year later another agency contacted us about the exact same thing. Told them I knew nothing about it and that they needed to send me written evidence where it clearly states what the debt is and to whom the money was originally owed. Never heard back.

I wonder how many people fall for this kind of scam :(

Thats not correct. They can still be collected and you still owe the money, But they have no court path to claim. They can keep telling credit agencies about the default and can keep sending you letters. If you acknowledge a debt even after 25 yrs the clock restarts

What I've done in the past is to reply back saying you have no recollection of any debt owing to them and as the debt is over 6 years its now statute barred
