Right - you may remember a few months ago, I slipped on a wrongly-positioned manhole cover and did my neck in?

Well I've only just got back to work the other week and I'm nearly back up to speed...A couple of people have asked what's been happening so here you all go:

After doing a bit of digging, it has been discovered that the plans and specs provided by the council called for a cast manhole cover (the nobbly steel ones seen on paths everywhere) and the plans have a note saying "Must be non-slip due to position of cover on walkway." (or words to that effect; I'm not at home atm so can't quote verbatim).

The work was done by a third party contractor who have accepted blame for not doing the work to spec and fitting a non-non-slip pressed aluminium cover.

We have just declined an initial offer for settlement before moving to court proceedings (advice given by my pet legal eagle...) and we have a meeting tomorrow afternoon at 2.

So...Fingers crossed for tomorrow.

Good news - my guess is having been off work for say 3 months you're looking at ~£5k total damages (say £2-3k LOE, £2-3k generals), want to start a sweepstake? Nearest person gets a grand?

Did you have to sign up for a CFA with ATE etc? If so I suspect the solicitor is rubbing his hands with glee, add another 25-40% to his fees recoverable from the insurers!

LOE = 4.3k min. plus my employer decided to let me go rather than keep me on SSP for so long...So I had to jobhunt again.

Solicitor is marrying my sister next year...That's why I decided to go ahead.

Known him for about 6 or 7 years now.

I should add that I took advice from him but used one of his colleagues for all the bits and bobs.

Nice payout,
Some one at work fell down a catch pit, think manhole but larger. Solicitor advised him to take the 2500 they offered, he refused and got 9.5k without going to court. if his knee wasn't already damaged he would have got a lot more. We've been on about getting these sorted out for years. So if anyone else falls down one on a night shift. i can see the payout being huge. For the small fact they are ignoring the problem.

Although I hate the compensation culture, sometimes it's the only thing big companies understand is when it hits there pockets.

What exactly is your problem? Its not as if he is scrounging for the sake of scrounging as you make it sound

Yeah but if such an accident occurs as a result of the fault and negligence of someone else, and that same accident also results in loss of earnings, then why should the negligent party not be held to responsibility, and compensation?

I don't like 'compensation culture' either, but this isn't an example of it. The bloke lost his job because he couldn't work due to his injury, he's hardly just moneygrabbing.

So if you have an accident, someone else is at fault, you'll just not work, sink in to debt, possibly lose your car or even your house - because 'accidents happen'?
