How many people seriously wear kilts in England? I'd hazard it's not even worth thinking about, and the legal systems are separate so this law means nothing in Scotland.

What's that got to do with anything? The law won't specifically state skirts.

What if it was accidental?

If it was accidental there would have been no intent to take the image and later view the image therefore an offence would not have been committed.

records an image beneath B’s clothing of B’s genitals or buttocks

Out of interest, you know all those PAP pictures, where photographers take pics outside of nights clubs of z-listers who are drunk in and out of cabs, and in and out of the club themselves.

I believe it already is illegal in Scotland and this bill was basically just the same for the rest of England/Wales.

Taking “upskirting” or “downblousing” images is already illegal in Scotland. The law was changed by the Sexual Offences (Scotland) Act 2009 which introduced a voyeurism offence.
