Hi guys so a card i bought in jan 09 has died this week, AN XFX9800GT.

I went into the shop to look for a new one and the guy askd when i bought it from him etc, he told me since its been over a year i would need to go on the XFX website and request an RMA etc, Did this today and the XFX tech said the responsibility in europe is with the reseller, and because the reseller is unwilling to help my warranty will be invaild... A little gobsmacked, The tec on XFX has asked if im intrested in a 'discounted upgrade'

Looking at there products it seems they have slowly dropped out of the GFXcard game as they havent been involved with many new cards.

Any comments on this ? should i just bin my card ?
 
I don't think they are working with Nvidia anymore...
But anyway your warranty is still valid, just go mad, and/or threaten to take them to the small claims court, if they continue to try to palm you off.
 
You don't need to threaten with court action, and considering the cost of the card that sort of action wouldn't hold and just wouldn't be worth it.

If it's in the T&C that the reseller should replace the hardware, then they are obliged to do so, but I would have thought XFX would have been a bit more helpful, go back to the store and talk to the manager, as someone else has said, if that fails get onto XFX again, and if that fails get the guns out and go to trading standards or some sort of watchdog.
 
if anyone is intrested the cards still at the bottom of the cupboard, both XFX and the shop refused to do anything and pointed at each other, so gave up!
 
Contact the retailer again and ask them if they have heard of the Sale of Goods Act. If the product was offered with a warranty this should be honoured by the retailer. I have recently had the same problem with a retailer not honouring an XFX warranty. Phone them again. If they refuse to honour the warranty ask for their complaints procedure and tell them over the phone that you will be contacting your local trading standards office as well as Consumer Direct for advice. If they hold firm and do not give in, then send them a letter of complaint by Recorded Delivery (telling them again that they should honour the warranty and address your concerns regarding the faulty item, and that the OFT/whoever will be involved.) You should then get a written response one way or the other. Only at this point can Consumer Direct or your local Trading Standards office get involved on your behalf should you need their help.

EDIT: Just noticed original date. I would assume that since most XFX cards have a two year warranty you are now out of date. However I would still chase this up through the above channels since you can presumably prove that the retailer refused to accept the return at the date you tried to get them to accept it back as faulty under warranty.

Well XFX don't have to do anything as you didn't buy it from them.

It's out of warranty so you can't get a replacement but you can get some money back no wouldn't really bother TBH. too much hassle for £20
