What would you do in this situation

Your a ***** (stabbing item). Stop taking life so seriously...Answering your mobile when driving doesnt mean instant death. Give it a break.

What would happen if he went to the police?? Would I be in for a fine or would they tell him they are not going to do anything because he was breaking the law???

I doubt they would do anything to him. You will need at least proof that he was driving the car / the engine was on (which ever the law dictates), you are the person who took the photo, proof it was a taxi etc.

As said though, you will probably get moaned at for not paying the full fare.

Interesting fact...if the phone is attached to the car e.g. by a wire, you can still use the phone and drive you car. That is why lots of taxis still have the hand held wired walkie talkie things in them because you can not get 'done' for using it. I'm guessing this is why you are allowed to use a hands free kit because it is attached to the car. Even though you still have to look to press the answer button / end call button. Look through the phone book to make a call etc etc.

Smoking, eating, drinking answering your phone, talking to passengers, skipping the track on the cd or changing radio station etc all distractions while driving so any can cause you to have an accident.

Thank you for answering my question.

I'm sorry guys but I am strongly against people using their mobiles while driving as I have a friend who is now servilely disabled from a car crash which was caused by some guy using his mobile while driving. It is illegal for a reason you know

Fixed.

Honestly, do you think the crash would have not happened if the guy was speaking to someone with a handsfree kit ? Or dialing a number on his parrot handsfree controller ? He was not paying attention.

The reason I asked why you drive is, I can't imagine any driver not acknowledging how much a distraction a handfree convo is, or simply looking up that favorite tune on your stereo... When I pick up the phone while driving I always put it on speaker as I'm afraid to get caught if not speaking handsfree, but I still notice my attention is gone, whenever I speak to someone I'm slower with things like gear changes, indicating, etc... Or, when something is happening on the road, I stop in the middle of the sentence to concentrate on the road or I'm lost in the convo, what I'm trying to say is, speaking over a mobile while driving is dangerous, regardless if it's handfree or not.

It is illegal for a reason you know

Many things are illegal for no good reason at all, but, if I'd start about that you'd have a post a whole page long...

I agree with you on the principle. I've seen idiots even texting when driving which really irks me. I also see idiots turning into roads pretty recklessly because they're having to do it 1 handed...usually they don't slow down to avoid changing gear.

However, I probably wouldn't have said anything to the taxi driver - maybe a polite reason why I didn't think it was fair for him to do so with a paying customer at the end of the journey... in an ideal world.

I would do nothing, because if he wasnt paying attention and run someone over killing them i really wouldnt care...

Hold on a second, i would care, it would be perfect, i could blackmail him into giving me money, and in return for a few thousand, i would tell the police the person run out into him

So my answer is to encourage this behaviour

The old bill would just say that they have to catch him at the wheel driving and using the phone at the same time.
If you feel that strongly about it then report him to the cab company he works for but as for actually getting somewhere ...forget it.

Seriously, we are actually entertaining this conversation?

So what if he used his cell phone while driving? I do it all the time and I am fine. Sure it's not safe etc - but neither are hands free kits.

What would I do in this situation? Thank the taxi driving for giving me a lift and pay the full fare, No insults!

wow, second thread in two days where regular members here are attacking the op for no decent reason. What the hell is up with you people, if the OP doesnt want his taxi driver using a phone with NO hands free (lets forget hands free kits shall we? irrelivant) then you can be damn sure he wouldnt drive and do the same himself.

I dont do it, and i wouldnt expect anybody driving a car i'm in to do it - yes, i do moan at the Gf when shes driving and she picks up the phone. it's a distraction you dont need when driving a car and quiet rightly it is supposed to be illegal.

Sure it's not safe etc - but neither are hands free kits.

dont do it then?

What would I do in this situation? Thank the taxi driving for giving me a lift and pay the full fare, you idiot,.

idiot? oh well done. no, seriously, bravo. you admit to driving using a mobile, you admit its unsafe but do so anyway...and you call the OP an idiot.

now, using a mobile might not be against the law in SA, i dont know. But it is here, for good reason. if people want to do it, thats fine. but if people dont want to do it then more power to them, they certainly arent idiots.

How can he have a valid argument if he is also breaking the law by not paying? Hence my reply.

Two wrongs, don't in fact make a right.

OP fails at common sense by being dropped off at home after not paying, and failing to set the right example by not paying.

It is indeed illegal to decline making payment for a taxi journey as others have said.

You get a taxi to get home from work? surely there are much cheaper options than taking a taxi!

EDIT: ah posted at 3:52am, understandable i guess

Is this actually correct? im sure i read somewhere that unless a fare is asked for in advance or the taxi has a meter, you arent legally required to pay anything.

He didnt decline the payment either, he did pay a reduced amount. if i'd asked a taxi drive to stop of at point b instead of point a i originally asked for, and then he goes and drops me off at A asking for the full amount then i wouldnt pay full either.

I'd have taken all the details to the council who license him (having paid the fare) and made sure they did something about it. It was a black cab so everything should be traceable via the council.

Far too many ****s think it's ok to use their moblie whilst driving and will come up with all sorts of irrelevant crap to try to justify their irresponsible actions: should be a minimum £500 fine and 6 points IMO .... that might actually show them that it is taken seriously.

We all know that it is against the law and we all know that it is dangerous; why try to justify it with spurious arguments?

Personally whilst I hate hate hate people who drive whilst talking on their phone, I'd mention it to him, but if he ignored me I'd just let him get on with it... it's his licence his choice. I always ask people do drop me round the corner from where I live as a habit I've always done - but that aside, I'd always pay the fair irrespective of what they're doing. If I'm not happy with the driver as in, deeply unhappy, I may well report him, in my own time, or ask him to pull over and pay the fair that is outstanding.

Just because he was breaking the law doesn't mean you should too. And it's rather daft to rile him when he knows where you live no? That aside, you knew you were close to home, why make such a fuss?

I admit though I do give a "phone" gesture when I see people on their phone driving, but other than that I don't have any power over people to stop them doing it and in London it's not really sensible anymore.

It's a service just like eating at a restaurant if the food was terrible and the wine was oxidised would you pay for it?

Yes, depending on the circumstances, they'd certainly not get a tip though ;) :D. Then again most restaurants I'd eat in, would offer the dish free and a second bottle of wine FOC - this has been the case on numerous occaisions, you just need to say the right things to the right weights. The sommeliers in restaurants have always been on my side if a wine bottle is off though. :)

I agree but there will be times when you visit a new restaurant and it's terrible and the owners couldn't give a ****

Just like the OP asked him to hang up and even got a posed picture.
