Whose fault is it in this situation?

I particulary enjoy cyclists who think that road rules/laws dont apply to them ... o theres a red light, its ok ill cycle through it, my tight red lycra leotard will save me when i get splatted by the artic coming the other way!

sod the highway code.. i ride on the pavement.. the dangers are less for everyone in my eyes. i dont go flying about like a mad man on the bike and have never hit anyone (you have to be stupid to do so tbh) and even if you were to hit someone.. you will have to hit them with some clout to do serious injury.

the road is a dangerous place to ride. a car dont have to hit you hard to snap a leg

i know ill get flamed for this.. :p

but its all in my *opinion*

That's my pet hate, they see the red light, pop up onto the pavement, round the corner, then back on the road again :)

whats wrong with that they arnt skipping a red light.
some drivers are idiots as well though not just cyclists. i had a guy jame the brakes n right in front of me while he was driving in the bike lane. then move off and jam the brakes on again. he did this repeatedly

Both are as bad as eachother really, I've had some drivers do very stupid this when I've been cycling and some cyclists doing some very stupid things when I've been driving

About the hogging the lane though, sometimes its very deliberate, if its a situation where someone overtaking me would be dangerous for me I will move out in the road to STOP people from doing it, I think its called claiming your space or something like that, saved my neck a few times!

i admit i do do it only beacause i dont like unclipping and clipping in again
Don't use clips if they make you break the law because you can't be arsed to unclip them.

The dangers are less for everyone... Apart from pedestrians who are MEANT to be on the pavement. I get p***ed off with cyclists almost knocking into me when im on the pavement and they come scooting round me. Makes me want to push them off the bike :D I've come close to doing that before!!

a bike hitting you aint half as bad as a car hitting you.. so dangers are less.. :p simple logic lol

Cyclists should be on the road, overtake on the off side and not "filter" through traffic on the nearside. If you checked your mirrors when moving off and the numpty wants to undertake you, then that's his (or her) look out. Two lanes of slow moving, queueing traffic on a road and the inside lane moves a little quicker than the outside lane is ok.
Even if you hadn't checked your nearside mirror the instant you moved off, it's still the cyclists fault. I sometimes cycle and never pass stationary traffic on the inside just in case a passenger decides to disembark from a vehicle. Now, they NEVER check their mirrors simply because if the driver has them set correctly, the passenger can not see behind the vehicle but only if someone is sitting in the passenger seat behind them. I would draw you a ray diagram to explain but I can't be bothered.

In summary, it's the cyclists fault. And as for insurance, if they have house insurance, they normally have £2 million worth of liability insurance so sue the pants off them..

Their fault. From the Highway Code:

Basically the same rules apply to cyclists as do to motorcyclists when filtering through traffic, i.e. you do so entirely at your own risk.
depends if OP was indicating. if i was taking this one to Court i would not be confident for either party.

possible 5050 split on liability, but the Court's would possible lean in favour of the cyclist as they are they vulnerable party who is owed a higher duty of care etc.

I have cycled over 260miles in the past month and TBH its scary.

I cycle home at night 10pm and people come flying round the corners at this time, They do well over 40mph in the 30 zones. They overtake over cars and just dont care if they hit you or not.

Old people are the worst either they hold back when there is loads of room to pass me or try to squeeze past.

I bet everyday I come across 2-3 drivers that dont see me or think they are better than me.

I now know where the worst parts are on my trip to work, so I will cycle on the path to avoid being knocked off. I dont go on the path at traffic lights unless im going to the shops and I will jump off my bike.

Most cars at traffic lights seem to think I shouldnt be there even though I can pull away as quick as them if not faster and safer. Once I have pulled off I will move into the left as quickly as I can.

HGV are decent drivers they will give room but those big massive skip drivers and delivery vans are the worst. BMW and boy racers give no room at all.

I cycle on the inside at traffic lights if the traffic is built up, I dont really want to be stuck behind all the cars and around here this is not one single cycle lane. I have to ride in the gutter and pot holes and really sunken grids are aplenty.

I am waiting for the day a driver opens the door and knocks me flying, on the way home nearly my village its terrible for cars parked on the road forcing me into the middle of the left lane.

I detest riding on the roads around here.

First pet hate is the ******* that shout at you from vans, your common class IQ they can count on one hand builder p****!
Second is drivers who wont overtake you, thus holding up traffic/getting me nervous as to whats going on.
Third is people that tell me i shouldnt be on the road.

Now when i ride on the pavement im forever getting told by fat drunken old guys that i should not be on the pavement.

Then when i go to the local country park i shouldnt be riding there either, apparently.

Well where the **** am i meant to ride then? and whats with the big advert campaigns on tv about cycling if im not allowed to do it anywhere

I always try to be nice to ped's and let then infront of me and stuff like that,my mate not so much and makes "us" look bad. If i fly round a corner and scare somebody i say sorry,i went down a handlebar width path and a woman was walking the other way..slammed on the anchors lifted my bike up so i could let her passed as easy as possible and carried on. Its not enough for some people.

To the OP though,i would give it 5050 in court, the cyclist could easily claim he was next to you and was probably in your blind spot or that you didnt signal etc etc.Wouldnt be worth the hassle.

I have had people chuck stuff at me, even had 2 boy racers spray some liquid at me near the town centre, I road after them and he drove through a red light as he knew I would have caught him and that I would have done somthing to his car. I would have ripped his wing mirror or scracthed his paint with my brake lever.

I not seen his car since but when I do Payback, its a red 206 with a massive 206 down the side in white and has a huge exhaust tip.

I get **** like that all the time. A prompt one finger salute shows i dont like them.....and the odd "SHUT THE **** UP YA SPOTTY WEE *******!!!!!!!"

Me and my mate had a group of four in a E46 convertable giving us cheek,a swift "shut it and get an M3 then i'll begin to respect you" shut them up lol.
Possers sitting eating micky D's with the roof down. :(

When I rode my mountain bike around Vancouver there were very few areas that I wasn't staying with traffic, so I never had much of a problem with cars. I just became another vehicle in the flow of cars.

When I did have a problem it was mostly from clueless drivers shouting at me to get on the sidewalk (pavement to you folks) where I belong. To which I would reply that they were wrong and needed to go take a driving test again.

Other times were when traffic stopped for a red light. I would be sat behind the car in front of me, lined up with thier number plate. Numpty behind me yells for me to get out of the way. I ask him where the hell he's going to go, there's a car 6 inches in front of me!!!!

Funniest thing is the biggest problem I had was BC Transit bus drivers being TOO curteous to me!! They would actually stop and hold up traffic to let me pass (on the passenger dor side) before they would pull into the bus stop area!! It got to the point that I learned what busses were stopping where. Not so I knew what bus to catch, but what bus I needed to be outside of so I could pass them on the proper side when they came to a bus stop!! :)

i frequently get abused by drivers even though im in the cycle lane. i also get things thrown at me. occasionally and its happening more than ever now women put there hands out of the passenger window and slap my ass which is a bit dangerous when your on a racing bike knocks the balance a bit
