Wife Forced Off Road By Supermarket Lorry

So if a lorry that was two lanes over, indicating right suddenly cut left over two lanes while running parallel to you, you would allow it to hit you? Or would you take evasive action even if you ended up on the verge? It's not always possible to anticipate other drivers especially if they are doing something the opposite of their indication.

To be fair, last time someone did this i did let them. I got a reasonable payout from it!
 
A word of advice.

Any motoring incident posted on OcUK will be analysed to the n'th degree and fault will be found with driver regardless of lack of knowledge of the situation/driver ability or other traffic's unusual manoeuvres.

Just pick the comments that are useful, ignore the rest and don't worry about it :)

If it was me, I would write a letter with as much detail as possible enclose a copy of any invoice for work done after the incident and ask them what they would like to do to remedy the situation.

Keep it professional/simple and too the point.

Worst that can happen is they say no. Good luck!

In fairness 100% of drivers involved in an accident are going to protest their innocence regardless of actual fault. Add some waterworks to the situation for added realism... ;)
 
It seemed surprising your damages were limited to just two tyres and not the tracking or even suspension components, did the garage assess car and write up a formal quote that you could have sent to superrmarket ?
 
Testo's roundabout. The lorry coming from the Tyne Tunnel side, my wife coming from the Newcastle Road entry. Note that her lights were green and the only way there should have been moving traffic coming from her right was if they'd skipped a set of lights on the roundabout itself.

I've more or less decided not to pursue it. I'll simply not shop at the supermarket the driver was representing :p

So the HGV was coming from the right on a roundabout?

Traffic lights do not mean you can ignore vehicles on the roundabout.

Was the HGV signalling to exit?

All time I was reasonably assuming the car was to the right of the HGV providing some basis for blaming the HGV.

If the truck was coming from her right then she would have been to his left,his near side and most likely initially at least in his blind spot,trucks when turning have greatly reduced visibility due to how the tractor and trailer behave in such a scenario, on the face of this an experienced professional driver has a run in with an inexperienced one, the incident resulted in the former blasting his horn at the latter.

I as an hgv driver only sound my horn as a warning to others, not when I'm in the wrong more so to warn they are.

Difficult to know it all about what went on here but I bet she's more careful around trucks in the future, all part & parcel of gaining experience and road sense....
 
Just because someone is a 'professional' driver doesn't mean they are not a ****. Personally I probably wouldn't pursue it though and just chalk it up to experience.
Non fault claims putting your insurance up are a huge con and should be illegal IMO.

Indeed. My wife is no more and no less reliable than any other witness, but she isn't lying to me about how she saw the events unfold. I allowed myself to get drawn into the discussion about how the incident happened, aware that some posters always feel obliged to see how they can blame the victim. It's the way of the world :)

However as mentioned above, the tyres are paid for and the risk of a no fault claim being chalked up is too great for me to pursue matters further. My wife was unhurt and I won't shop there again.
 
This is a proper big roundabout, as wide as a motorway and controlled by lights on the roads leading onto the roundabout and also with lights at various stages around it. As one set hits red, the next hit green immediately. The lorry driver was going right and was in the right hand lane, went through a set of lights just ticking onto red (time is money, pal) as my wife was joining the roundabout. He then cut across all three lanes into the left hand lane where my wife was. He simply didn't see her in his haste to jump a set of lights and save himself 2 minutes wait. She's only part time so this muppet cost her two days wages before she even got to work.

My only concern is claiming off them and then being obliged to declare it as a no fault accident.

So he cut to the left hand lane for his exit (normal) your wife didn't realise and joined the roundabout where he was going, likely in his blind spot. Ever tried to stop an HGV quickly when the lights change? if it was Amber (stop if safe to do so) then he is within his rights to continue if it wasn't safe for him to stop. Not saying this is how it happened, just saying maybe the lorry driver has a different version of events.

So many variables but I would want to hear both sides of the story rather than just your wife's side.

@op if you don't ask your insurance to be involved then there isn't a claim. The supermarket have said nothing happened so there insurance will not contact yours. You will just have to hope they pay out.
 
It happens to everyone on every internet forum ever, its rather bizarre that some see it as an OcUK thing. It isn't, its a people on the internet thing. People discuss stuff, sometimes it's what you want and sometimes its not.
 
Whiplash, damage to the car etc throw the book at them.

Someone who cuts three lanes of traffic on a large (and I assume ...busy) roundabout is a liability. He's took the easiest option, not the best one.
 
If I'm turning right at a large roundabout, I will also be cutting 3 lanes??? How else will I be getting off?

All other entries to the left of me should be giving way. I would also be signalling to exit.
