Work Disciplinary

Although she would probably have a case that could be fought, does she really want to go through the stresses that will surely come with it? Also the workplace is clearly not professionally run so does she really need to work with idiots, who will have axes to grind, and, as you say, she could get another job easily.

1 months extra payment is fairly generous after 5 months working and also she'll get a reference. If it was my gf i'd tell her to take the money and stick 2 fingers up to them (not literally!)
 
Dear god, another possible statistic in the country without a damn job.

Makes my blood boil how some employees are treated and paves the way even quicker to the wife and I quitting this country and moving to France. At least they treat their employees better.

She doesn't qualify for a tribunal until 11 months, so unless she is prepared to fund a private action against the company (for stress/distress) she has no legal legs to stand on. Unfair? Yes, entirely, but that is the way it is, unfortunately.

I agree - if she gets a (good) reference from them, then I'd cut and run. The temptation is to fight a righteous cause (as I did) but it is unlikely to amount to anything unless she can get them for sexual/racial/religious discrimination.
 
take the money, scowl for a week and then job hunt. sounds like a bunch of bankers to me!

I think that is the best option tbh, they seem like they want rid and don't seem like a company worth working for.

Anyone for some photoshop Friday fun ? all we need is to mock up a picture of the pope, dressed as the KKK holding aloft a ***** and then shop it into the companies brochure (preferably with the manager shaking hands with the racist / sexual deviant pope).
 
OP if your Gf can afford it take the money and run, it looks like if she stays she will eventually have to leave with nothing. Unfair like other people say but I think this is the best option. As others have said not all fights can be won even if you know your in the right, theres always people wanting to screw you over.
In the current climate companies know theres not many jobs around and are using that to treat the ones with jobs like poo as they know theres little chance of them leaving as theres no where for them to go.

I wasn't expecting evidence of all types of discrimination - one would do - but I guess the more the merrier.

PS. The Pope is Catholic *and* German... If you can't get evidence of racial/sexual/religious discrimination, you ain't trying hard enough. It's more a case of who he doesn't discriminate against! ;)
 
As others have mentioned, as she's only worked there for 5 months, most of the protection that employees get (page 1 posts) don't apply, its sucky :(
The company invloved are in professional terms 'a pack of asshats', asking her to make up her mind by 5pm today just makes that even clearer. If she chose to stay, they would just say she hadn't improved on the report and release her with no extended pay. I can't imagine she would want to stay there with such numpys after all this, id take the 2months pay and say thanks, might still get a decent reference.

I got called in to a disciplinary twice in the space of two months in my last job refusing to do overtime on numerous occassions simply because I did not need to or want to.

So everything I did from that point on was critisised and I'm pretty sure I was close to being sacked before I walked from stress.

Same here. I spoke out against the shop keeping its staff behind after working hours to clean up without giving them the option. I eneded up having to walk because a) they probably would have got rid of me on some other grounds and b) None of my workmates had the guts to stand by me, even though it ****** them off too.

The arguments were good while they lasted though :) its something they'd been doing forever apprently "You can only leave when we tell you to, not when your contracted hours are finished". I basically told them they were in the wrong and when i started walking out after my shift finished and they tried to confront me I just smiled and said "I'm not having this argument again". Almost took it to HR.

Apparently they've stopped doing it now too! (my flatmate works there) So I'm glad i made a difference :)

Well it's over for now. After speaking to Acas it seems she hs no chance with her limited time worked. She called her boss and took option number 2. Now it's just a case of waiting for this in writing.

Interestingly they have bumped her off with a decide now or lose everything threat. If we had the money it would have certainly being interesting to take matters further. In the real world she now needs to move on and look for another job.
 
Where is the legal stance on hours? my brothers boss makes everyone stay behind til hes finished for the day even tho its sometimes 20 minutes after their contracted hours.

Couple of jobs ago they tried to make everyone stay on til the work was done, I just slipped out once my contracted hours were up and left just ahead of the disciplinary - I had a 2 hour bus journey each way as it was.

Was it TK Maxx by any chance? My cousin works there and faces this.
 
Can she get any other teamleader / manager to deny his comments?
does she have to clock in / out? if so does she work over muche even if only by 5 - 10mins she can say she even works over to finish what she was doing rather than dropping it and buggering off
 
Things have taken a strange turn.

Her boss has asked her for a resignation letter, following which he will write a 'glowing' reference and post to her. She can then make any adjustments she see's fit and return. Once confirmed this will be the reference the boss will use when her next employer asks.

Within 20 mins of the resignation phonecall my friend has called to me to ask if Sarah is okay after getting sacked. The link is Sarah's work colleague (who knows nothing about this) has told her husband who has told his mate who has told me.

Sarah was infirmed today's events are strictly confidential between the 3 of them attending.

Probably means nothing and I'm sure the team needed to know she will no longer be working there, but those rumors and whispers took all of 20 mins to travel. So much for the confidentiality and there was no sacking anyway.

The last thing she to her boss on the resignation call was.......
There is an invoice on my desk that needs chasing up on Monday. I would have dealt with this today. They will ask for me so please apologise I can't deal with this for them.

She should have refused, and gotten a sick note from the doctors for stress, blamed the whole thing on stress and no employer can do anythinig about it.

I had this in my previous work place. Within 4 months they tried doing the same thing to me, so I went on sick. They couldn't do anything and I blamed them due to my stress and they still had to pay me, a month later, they rang and asked how I was, and apologised for any stress they caused. They gave me a lighter load and I lasted there happily for over a year.
