Realised my day one pad is broken. The shoulder buttons are very hard to press but I didn't realise it was a fault until I tried another controller and the ease of pressing their buttons.
What's the deal with taking back a pad?

So tonight i used my headset / mic for the 1st time while playing forza 5 the Party coms sound came via the headset , but the game sound still came via the TV speaker , how can you change it so both coms and game sound are output via the same device ??
as i had to turn down the game sound very low just to hear the Coms sound via the headset.
Log into your router and set the DMZ to the IP of your Xbox. Can't give you any more details than that as you haven't even told us what make/model your router is.

so i get the i.p addy from the settings on the xbox then goto the dmz in the router and do i put the full ip in those 4 boxes then (anything else i need to tick or enable)
do i also leave upnp ticked on or do i need to turn it off and do i need to do anything with any ports ?

Well UPNP = Universal Plug n Play so should handle the forwarding for you. I assume whats happening is one xbox is connecting to the TCP/UDP ports so the other is in strict/moderate. This would also happen if you're using static IPs instead of letting DHCP handle it.
I would create some rules so that your xbox connects to these ports:
Port 88 (UDP)
Port 3074 (UDP and TCP)
Port 53 (UDP and TCP)
Port 80 (TCP)
