I ordered a couple of refurb Tesco hudl tablets off ebay middle of January, paid via paypal.

2 weeks later no sign of them so I message the seller and he provides a tracking number that has a signature I don't know. So I check with the neighbours and they don't have it. Seller wont help so I open a dispute and he wins as he can prove it was delivered. So I ring royal mail and it turns out they have GPS coordinates of where its delivered - the next street from me.

So eventually I get my tablets from where they were incorrectly delivered. Fast forward to today and one of them stops working. This is 2 days outside of the sellers 30 day returns window ( even tho ive had them less than a fortnight ). I went onto ebay to arrange an exchange only to be told by ebay I'm too late.

So now I'm left with a broken tablet. Ive messaged the seller to ask for a goodwill exchange given its only been used for 2 weeks. However if he refuses I'm thinking of mentioning that he has responsibilities as a business seller and I don't think its reasonable for the device to fail so soon.

How much luck do you think I will have if I try to argue my consumer rights? In fact, do I have any consumer rights?

Were only talking £35 but its the principle more than anything.
 
You can raise a PP dispute up to 180 days after a sale, you obviously won't get a replacement tablet but you'll at least get your money back or it may give them a kick to just replace the tablet.
 
Seriously? You bought some refurbished rubbish for £35 and now you want it exchanged?

Sucks that Royal Mail messed up originally but that isn't the fault of the guy selling from Ebay.
 
35 pounds is not worth the time that any corrective action would involve. You have no idea if you have a case, what your rights are or what to do - it may be a good time to put this one down to experience, champ.

I say if its stopped working its no longer as described. So try Paypal dispute over ebay.

The fact you went out of your way to collect them, was that a Royal mail mistake or a wrong address/postcode on the address label? Maybe its worth asking the royal mail stating that due to them you didn't get to return the item under the 30 day ebay protection.
 
I dont see how the seller is responsible for this as it is the fault of RM. Sure you can open a PP case but its not worth the effort and time and to be honest, i think is unjust on the seller. Surely this is just a case of putting in a claim with Royal Mail over the miss delivery.
 
Yeah wasn't the blokes fault that RM cocked up. Looked at the original paypal transaction and it just links to the ebay resolution centre which in turn says I'm too late.

So unless the seller exchanges it as a goodwill gesture it looks like ill have to put it down to bad luck.
 
tbh, you just saved yourself some ag in dealing with those things. Hudls are Eol and had a considerable return rate compare to other products (though still only a small fraction of the total).

I would search MM for tablets even if its for the kids.
 
You bought some second hand goods with return terms of 30 days and one broke outside that. That about sums it up really.

Unfortunately for you RM messed up the postage and best case is that you could put in a complaint but I doubt you would be able to claim anything from them either
 
in hindsight you would have rang RM before opening a dispute. then at least you could have provided PayPal with the info that it was delivered to the wrong address. not sure how this would help of course.

can you open another dispute on PP even if you have done so already? the new 6 months rule really stiffs sellers.
 
People in this thread who say it's not worth the time must be on mega money? Takes a few emails and then a trip to the post office. So around 30 mins in total.

I just don't like how he is trying to make the seller pay for his inability to chase up an order until 2 weeks after it's gone missing.

Then when sent with proof of delivery and a signature, he is still looking at a way to get a refund or free device from the seller. As much as we slam ebay sellers generally on here, this is not fair one bit.

The item breaks and he wants it replacing. What's wrong with that?

OP was a bit slow with chasing it up bit who expects to have to chase up your own order? That is down to the seller. If whoever had the tabs said "no nothing has been delivered here" OP would have been out of pocket at no fault of his own. But it's neither the sellers fault.
 
i'd be far more interested in raising a police case against the **** who knowingly signed for goods that weren't theirs.

Who says they knowingly did anything? I've signed for all sorts of parcels very rarely do I actually check they are for me until after the postman has gone.

If it's delivered to you, you have the right to sign for it. Could be a gift from a family member or a free gift from some company or anything.

I haven't had a delivery in the last 3 years where the delivery guy hasn't asked my surname before asking me to sign.
OP had the tablets been opened and used by the guy who signed for them?
 
The case has been closed by ebay. So it appears ive lost, again. I didn't wait 2 weeks to chase it up, I waited a week then messaged him. He ignored me so I opened a case then he uploaded a tracking number. I questioned the signature and provided proof that my address gets mixed up with others all the time as there are 3 streets with similar names, Anchor Place, Anchor Terrace and Anchor Road. During all this I get an eviction notice for one of the other streets so even the council cant get it right.

I'm not trying to get something for free either! I'm after a device that works. The seller is a business seller so I think I have a right to expect something to last longer than 2 weeks ( or 32 days from when it was wrongly delivered ). I did not ask for a refund I asked for a replacement. These are sold as seller refurbed

As it is I will chalk it up to experience, but should the 2nd tablet also break I will be seeking redress through court. I'm sure ill have a great day out to see judge rinder.

Good quality and perfect working order. Buy with confidence and if there are any issues do contact us and will do everything possible to resolve it.

And looking at his feedbacks in the last month of 11 neutral and 6 negative for non receipt of items and general bad attitude it seems I'm not alone.
