Friends car clamped and tow

If the car was legal and he was parked legaly then i would report the car stolen

From a few links i found through google, people have done this and then the police call them back and say it's been towed away for parking illegally and thats as far as they go.

When you say illegally parked what exactly do you mean?

IF it was on private land and this company happen to be the parking control there is nothing ilelgal about it other than trespass (not criminal).

An illegally parked car would be one on the public highway with a yellow/red line...

As slick says - call the police.
 
It's most likely along the lines of his mate hasn't got the balls, intellect or desire to contest it, and when confronted with a large release fee and daily storage cost has believed them when they have said 'pay or we will crush it'.
Either that or he's told them to 'crush it then as I'm not paying that'

I don't think any advice will change this.

It's difficult to prove the dishonesty and the intention to permanently deprive points of the offence in this case.

What's the stance in England? "Don't care"?

No offence intended obviously. It's quite clearly extortion at the very least - why don't the police do anything about it?

In England and Wales it's not illegal like it is in Scotland. It's nothing to do with enforcement, it's all to do with what the law actually says.
 
I feel like i'm getting nowhere here.

I'm genuinely interested in why clamping and threatening to tow a car and charging a lot of money to release it is not extortion. It's been proven that private companies do not have the right to impose fines on people and that said punishments have no grounds in law.

So what they're doing is theft, as they have no legal right to remove your vehicle, or charge for the process either.

So why do the police let it happen? I have no real knowledge of law myself, hence why i'm asking. :)

I'm also thinking along these lines. The law is on your side if what you said is true.
