So does that mean the next time I spot a CPU on OcUK for £0.00, I can quickly purchase it and argue the same point?

more like a 3ghz cpu advertised for 100 quid and when you open the box its only 1ghz....then you could argue the same point.
 
if you bought 3 cpu's from them for £0.01 and only one arrived then you would be in your rights to ask for the other 2 or return the 1 and get a full refund of 1p

I've ordered Blu-Rays from online retailers before (more than once!) and had my order cancelled and refunded after payment because the price was wrong and they couldn't honour it. You're saying they should have given me the choice and asked if I wanted it at the crazy price or a full refund?

What you're thinking of is the typical online thing of miss priced software and the company noticing the mistake and cancelling the order, but in this situation they actually followed through and sent the item which means they're pretty much ****ed, as it's no invitation to treat etc after you've actually sent it.

Yes, if they are daft enough to ship you the CPU for £0.00 and you receive it, they cannot then ask you to send it back. If they realise the mistake before shipping they can cancel the sale.

no he's saying if they sent it to you they wouldn't be able to claim it back.

They can cancel it before they send it though :)
 
If I were in her position I would expect a full refund (and I keep the product) or two more licenses.

One license might be useless to her, could be a small business which needs three. In which case maybe there's a cheaper alternative for three licenses somewhere else, except she couldn't use that now because you're not refunding her all her money and she's stuck with one license, paid for, and cant afford two more.

She probably took a bad tone because you offered her such a miserly deal. Just refund her (cheaper than giving her two more) and move on.

What you're thinking of is the typical online thing of miss priced software and the company noticing the mistake and cancelling the order, but in this situation they actually followed through and sent the item which means they're pretty much ****ed, as it's no invitation to treat etc after you've actually sent it.

I think even if they deliver, if they can reasonably show the buyer knew it was a misprice they can get it back.

No contract is formed until they send it, they can refuse to honour the price as much as they like until you recieve the goods if I recall correctly.

OK so that's the difference in this case then. That's what it comes down to.

So, he could still refund the money and leave the customer with the product, would that satisfy any legal requirements? Then she has something for nothing.
 
She bought somit listing 3 licences so give her 3, its a loss to you but you pay for your mistake not her. Since you have accepted the money already their isnt much you can do especially since she has used the software already.

Just be more careful in future.

no because it would have been in the t&c's they could cancel the order


if the transaction had gone through and they had taken payment , delivered the goods only for you to find 1 blu ray instead of 3 then you would expect them to provide the other 2 or give you your money back

I realise this now, but thanks for the clarification.

What it seems to come down to is whether he needs to simply refund the first item in full (which is my opinion) or go on to provide another two items free of charge. Legally speaking. Morally is another issue, but from what I've heard that ship has sailed if she's being a tit.

Yes I can blame her if she's being arsey and unreasonable. It's hard to say exactly as the details are vague. All she should do is simply ask for what she wants with no attitude or disrespect. The retailers are just people too, from running a small business day to day myself for a bit I can say most people are perfectly reasonable, but you do get some people who take you for a ride and are rude and abusive over nothing, which leaves you with a very bitter taste in your mouth and a lot less trusting.

I would like to add i never offered her the £14.99 refund as i came here to check first. Her threating was literally about a product she received today after ordering yesterday there was no erm excuse me you have made a mistake it was " I'm ***** off and i will report this matter to the TRADING STANDARD INSTITUTE " ( actual quote) the funny thing is usually i would have gave her the 2 Product keys but after that tone and as i had already gave her a massive discount making it the cheapest in the UK i started thinking what is the cheapest way to sort this as i obviously wont be getting a positive review. It turned out that the cheapest way was the thing she wanted.

Of course you should give her either a full refund or 3 licenses as advertised at the point of sale. It's YOUR mistake, so it would be completely unfair and (what seems to be more important to you:rolleyes:) illegal under consumer law to offer anything else except the options above!
What's your website? Let me add it to my 'never do business with' list!!
