Split everything down the middle, keep it amicable and move on.
I know its easier to say than do, but hating, revenge and bitterness won't help anything. They move on and you are left with years of ****!
67Voyeurism E+W+N.I.
(1)A person commits an offence if—
(a)for the purpose of obtaining sexual gratification, he observes another person doing a private act, and
(b)he knows that the other person does not consent to being observed for his sexual gratification.
(2)A person commits an offence if—
(a)he operates equipment with the intention of enabling another person to observe, for the purpose of obtaining sexual gratification, a third person (B) doing a private act, and
(b)he knows that B does not consent to his operating equipment with that intention.
(3)A person commits an offence if—
(a)he records another person (B) doing a private act,
(b)he does so with the intention that he or a third person will, for the purpose of obtaining sexual gratification, look at an image of B doing the act, and
(c)he knows that B does not consent to his recording the act with that intention.
(4)A person commits an offence if he instals equipment, or constructs or adapts a structure or part of a structure, with the intention of enabling himself or another person to commit an offence under subsection (1).
(5)A person guilty of an offence under this section is liable—
(a)on summary conviction, to imprisonment for a term not exceeding 6 months or a fine not exceeding the statutory maximum or both;
(b)on conviction on indictment, to imprisonment for a term not exceeding 2 years.
Anyway if the lady does file for divorce there will have to be a reason stated.
People have a reasonable expectation of privacy in their own bedroom and it's certainly no surprise she is divorcing you given your activities in this thread. Both the Human Rights Act and the Sexual Offences act cover recordings like this.

To clarify, it was an mp3 player that could record sound only and was placed under the bed (obviously I wasn't discrete enough or ignorantly thought she wouldn't happen to look that far under the bed that night...). I was ideally wanting to catch her chatting on the phone either to her friends explaining why she was divorcing, or to her possibly phantom lover.
It's the marital home, in the bedroom that we shared until she forced me into the spare bedroom when she returned after three weeks away in the huff, no idea where (and incidentally turned up with four police in tow claiming I'd denied her entry to the house....yes, keys were in the locks front and back but she didn't even try to phone the house/mobile and I was watching a film at high volume worst luck..).
She was moody for months, initially it was over housework but even when I did a lot more she was still the same, and she just wouldn't talk to me about things.. Even now I don't know why she's divorcing me, I suspect it's because I'm 'selfish' and didn't show enough affection...her perception, not mine, but then it's her reality at the end of the day.
Her long term coldness (no 'intimacy' for five months) does suggest to me she's seeing someone, and she's bought some very nice underwear of late including time away from me..
Ultimately paranoia probably got the better of me, I shouldn't have done it, but then you do weird things under stress when you get no information.
So...we're pretty sure she could press charges on this then, on invasion of privacy grounds? And I want my flippin' hard drive back, I don't have a computer any more!!!
