What you quoted about licenses vs ownership is totally unrelated to any of what you have just written above though. I'm still confused as to what you think it means.
It's a clause to indicate that you only license use of software, you don't own it. This is the case with all software, as ownership remains with the publisher/developer.
Having legal ownership of the game/software would imply having rights to retail the game yourself etc. that's what that clause is related to, it has absolutely nothing to do with subscription services or anything like that.
I think before you criticise modes of business based on TOS, you should probably do more research into what those TOS actually mean, because at the moment I don't think you really understand them.
