at our place its a 6 month probation during which they can terminate your employment for no reason and with 1 weeks notice.

I was under the impression he wouldn't have a leg to stand on if he hasn't worked there over a year regardless of circumstances, so that might not be the reason.

Probation in most places is 14 weeks. I don't know many jobs who have a year probation unless it is specifically stated on the contract.

I have been told in the past by ACAS that regardless of your contract you would have an almost impossible task suing if you haven't worked there for well over 12 months.

That could be wrong but they seemed quite sure about it.
 
Its going to be lol in the administration when they get your emails of complaints and notice that you too are browsing non related websites whilst working? Dont they have a policy to actually work and 0% time to browse personal sites whilst not on a break?

Regardless to if your on the phone or not, your not committing yourself 100% at work so be it hes only doing 30% work and your doing 80%, your stlll as bad as he is and give yourself no room to comment.

I work on cnc machines at work, and most the time I have to stand around doing nothing, I'd like to read a book or play on my phone but common sence says that in doing that im not focusing properly on my actual job.

Well, its pretty ridiculous if someone is sat next to you doing the same job and doing no work and you are snowed under so to speak.

Its up to management to sort it out though, surely they must be interested if someone is doing nothing and they are paying for it? :p

I think it's fair to say that most office workers have a fairly high procrastination rate. Those who don't procrastinate are probably either lying to themselves or struggle to keep up with the pack.

So I'm not entirely sure that the answer to this thread is to tar the OP with the same brush he tarred the other guy with, like some vicious circle.

With hindsight though, OP, you probably shouldn't have led with his internet usage given the semi-ironic nature of it all. If an employee is a bad employee they're a bad employee. You can still be a good employee and procrastinate. The answer really is the quality and quantity of the work that you carry out vs the other people in the office. If his is lower then there's a problem, but that's what managers are for. They manage people. I'd let them get on with it.

thats from a point of view of tribunals LIKELY to be unsympathetic

theres no gold rule or legislation, as such most HR departments dont want to leave anything to chance and make sure its all the is are dotted and all the ts crossed (so to speak)

Why should he? He's having to do extra work because one of his co-workers is being lazy. Why should he sit there and do extra work so that someone else can get paid to do nothing?

That said if his system works like that of my own helpdesk then the management already know that he doesn't do any work.

That statement pretty much sums up not only co-working relationships, but middle and upper management too. Modern middle-class work ethic is centrered around being the person who gets paid the most to do the least. Look at most of your managers and their managers for proof of this concept. Heck, look at the people on the same floor as you that get paid more than you but do the same job... would you say they do more work than you? Probably not.
 
Like I said in my first post, no one else but me can see whats going on.

Hmmm. I'm in two minds. Unless it impacts you directly, I don't see why you should care.
There's many reasons, mostly moral ones so I'm guessing you're morally dumb to ask that question? Regardless of how it impacts him it is annoying to a team of workers have a slacker get paid for no work, its bad for business if he's not working like he should be, its unfair he has a job he isn't willing to do when others who need jobs are on the dole, its stupid to allow someone to get away with it regardless, its not worth the company, team or anyone elses time to cover or let him get away with it when he's already been talked to with a disciplinary and still not working. In the end bad for business, team morale, customers on the other end (who they are supporting and have a job to support yet should ignore leaving someone in who is counter productive to this goal they are being paid for?) and even the back log which effects the reputation of the company he works for which is obviously bad if people start badmouthing it and they get contracts taken away or whatever.
C'mon man your not thinking hard enough if I can come up with all that just in 5 minutes.
