My mate has got himself in a right mess with the police..

I work for an Insurance company and I know for a fact that we wouldn't persue a case as small as this.

If he's going to get charged it would be for wasting police time, not insurance fraud. The police have no way of proving it didn't actually happen.

http://www.iphoneinsurance.org.uk/iPhone insurance providers would definitely pursue a false claim, there were a lot of news articles last year emphasising that insurance companies and the police will actively seek out and and prosecute fraudsters. The rates of iPhone insurance insurance fraud had become so high, around one in ten claims were found to be false, they clamped down.

The police are not stupid, he has made a statement, but the police are inviting him back for another interview, which is not usual practice unless for an ID parade, they probably already suspect that he has made a fraudulent claim.

With regards to the phone the sergeant said to ring o2 and tell them it was recovered, man if it was me I'd want to kiss that sergeant.

That is unbelievable but Kudos to the Sergeant for using his Own judgement.
I hope your mate is clever enough to appreciate this touch & not do anything as stupid in the future.

Ok this is lowrider here reporting live from the scene on this rainy monday afternoon on my phone so excuse any typo's

He actually went into the police station this morning and told them the truth and he was let off !!, not even a cuation !

He said that the segeant said it was good of him to admit the truth when he did, he said if it had went on any longer he could have arrested him.

As I said, Honesty is the best policy and the Police are reasonable if you are truey contrite and they feel that he has learnt a lesson.

It is in no-ones interest to give this kid a criminal record over an act of idiocy.

I hope your friend realises how lucky he is and just how much trouble he could have gotten in and that the consequences could have lasted him a lifetime.

Why is fraud largely seen as just being ok? Similar to the old whiplash crew? Why is ok to screw money out of companies? The sense of entitlement most people have in this respect is just bizarre.

Its pretty easy to justify most things. Thats how people deal with being *****. Talk to anyone who has done something morally or legally reprehensible and just listen to the crap they say to explain how it was all ok.

Insurance fraud is usually justified by the truly idiotic rationale that "everybody does it."

I pay my premiums and everyone is scamming the system so when I scam the system, I am doing it to just redress the balance. It doesnt matter to big companies.

Its pretty shameful how dishonest most people are when it comes to things like this.

Since the insurance company have already dealt with the claim if he confesses now that will surely be insurance fraud regardless if he has not touched it etc + wasting police time?

He might feel that the nice Sergeant has let him off, but if the insurance company get a sniff of the fraud (when he claims it has been recovered) they will report it to the police. He certainly isn't in the clear yet, and all three offences that he committed could come back and bite him on the arse.

People believe that companies are so vastly rich that it's OK to rip them off.

The same as people who claim benefits that they aren't entitled to. The government has loads of money, so we can claim it.

Considering how big the lie was he just walked away scot free.

He is obviously just a foolish kid who has made a poor decision which he has admitted to and unless he had any previous (which he did not) or the lie went further than it did (which it didn't) then there is no reason to potentially ruin this kids prospects with a criminal record.

As long as he had learnt his lesson then I fail to see the problem with the Police's attitude and response. What would prosecution accomplish, nothing.
