why would you report a phone as stolen to get a free phone anyway because the old phone gets turned into a brick when you report it stolen

He told me that he just said it was 'recovered', that's what the sgt said to say, he said o2 barely even asked any questions, they are sending a box/bag out for him to pop his 'recovered' (old) phone into and send back, job done, I honestly don't think they (o2) care tbh.

As I said earlier in the thread he was going to send it abroad, outside of the EU, apparently they can still be unlocked and registered on the networks over there, I don't know 100%

The only reason he did the 'right thing' was because he was about to be caught red handed, it had nothing to do with a sudden change of heart or anything.

This! If everything was going smoothly i really doubt you/your friend would have admitted to anything. Otherwise you wouldn't have done it in the first place!
Let off very lightly IMO, insurance fraud is insurance fraud. I'm having to pay £40 a year for my phone insurance (iphone 4), and its becuase of people like your friend.
He is a kid to me, I take you point, I had been in the RM 5 years by then, but people don't mature at the same rate, and some just take that little longer to grow out of those kind of behaviours than others.
It seems the older I get, the longer it takes kids to grow up, don't know whether that is because they are more immature or I am just getting too old.
I can't help but think the OP is being spun a yarn here.

Maybe, but he could have easily waited a bit longer to see if they could have pinned anything on him first, the meeting he was supposed to go to today was to gather more evidence on his behalf, not interrogate him, ok there is a good chance he could have been found out eventually but he didn't need to confess this early, I think even the sgt understood that which is why he was lenient, he made a mistake that he owned up to before things gotten a lot worse.
Either way I know he felt bad about it, he said he wants nothing to to do with stuff like this again, he honestly thought this was going to jeopardize his university placement.

Why was he going to tell o2 that he lied about the incident?, you just ring up the call centre and tell a random operator that the phone was recovered in the case, they don't won't to know any more, <taps away on keyboard> <next caller please>, it's hardly a tribunal, end of the day the phone was 'technically' recovered anyway from the police's perspective.
And the police officer didn't just say "No problem on you way son.", he was taken into an interview room and had a good talking to but was also told that it was good of him to confess when he did otherwise he could have been arrested.
When he had the new phone sent through he didn't even bother opening it because he said he knew that it might have to be returned, but o2 asked for the old phone which he is sending back.
we all know its reallt the op and hes only now saying hes told the police he lied and they let him off...
we all know hes only saying this because people were saying if someone was to contact the police about this thread the OP would get in trouble.. theres even a few regular posters that are police officers , hes bricking it and obviously didnt really goto the station to say he lied.
its all far to fast! stuff like that doesnt happen in a matter of hours!

You know what annoys me about some of the people on here insinuating that it was me that did this, it's not the that I'm being accused of a crime I didn't commit, but rather the fact that people actually believe based on my history on here that I would do such a stupid thing, I honestly don't think I've portrayed myself as that type of character or as someone with such low intellect, I'm 33 years old, I don't even have a contract phone, here's my top-up card I posted a couple of days back for my San Francisco Android phone http://forums.overclockers.co.uk/showpost.php?p=18180441&postcount=314, I don't even own an iPhone, I wish I did.

first of all your friend is an idiot, not for his plan, it was a good one about 5 years ago, before the phone companies caught onto it and now block imei numbers. therefore he didnt research it enough, which is something you should be doing plenty of if your going to be breaking the law.
this means although you get a new phone for free, the old one can no longer be used or sold in this country, as it will be easily re-traceable.
what he has done is against the law, therefore it would be advisable not to tell the truth. he is now wasting serious police time, which could be used to find an actual real criminal.
tell your friend would he like it that a rapist or a violent criminal went free because police were wasting time trying to catch 2 non existent people? what if this rapist had raped his mum?
