Police Authority Question

OP is a fail...

Seriously, what is it with posts nowadays asking for advice on the most simplest things that require nothing more than common sense?

Becuase i don't see the reasoning behind why when someone has said they would admit to it they dont make any kind of attempt to contact them and still are only interested in me? The only reason I'm off the radar is becuase I made my mate ring her and say it was me even though i said to the police i can give you his contact details.

A little update - my friend has phoned the woman and told her everything, she has given him a warning or said he's getting a warning and gave him a slap on the wrist. Now what?

She gave him a warning over the phone? About what exactly?

Think she said the local force will issue it or something

Are you absolutely sure this wasn't just some elaborate windup.

It doesn't sound at all kosher to me.

The Police do not conduct investigations over the phone, issue cautions over the phone, conduct interviews over the phone or indeed tell your friend that he's getting a warning over the phone.

They would have asked him to surrender into custody as was told to you.

I would still call the local station to verify all this if I were you.

It sounds dodgier than Trotters Market.

If it's above board and not a wind up ( which is still quite possible), then the police should have mentioned a crime number as that is what such a case would be treated as!

Briefly explain what has happened over the telephone and then try to ascertain if it is an informal interview or an interview under caution. If it is the latter, you should really ask for a solicitor to be present, even if you haven't done anything wrong. You're entitled to legal advice so take it!

Regardless, the potential is there. What if his friend denies his involvement? or the girl in question says he has some gripe against her.

You do not know what the Police know, what information they will act upon and what the outcome will be.

If you think that the Police will go to any great length to do handwriting comparisons etc, then you've been watching too much CSI.
The above is precisely the reason you don't voluntarily go down, you don't know what they know, or at least think they know. If you know yourself to be innocent you are very unlikely to "prove" that to them just by your statements and open yourself up to unintentionally saying something that may appear to incriminate you.

It is more likely that they will decide that either he is telling the truth, or if not they will give him an official caution, hence the potential for being in trouble.
They can't just give you a caution, you have to accept it. And they aren't to be accepted lightly either.

Yes I phoned the local station. Maybe becuase they know we're students they try to take short cuts? I don't know.

Indeed, which is why I said arrange for legal representation before any interview takes place.

You don't have to accept a Caution, however you will be charged instead, again take or ask for a solicitor before doing anything.

I still think its all dodgy to be fair.

Did you ring your local number or the 1 they gave you?
What were their exact words?
What is happening with your mate?

Police do not conduct interviews over the phone OR give warning out over the phone as they could be giving them to anyone...

big deal out of nothing

bet she didnt say to go to the station for an interview but actually said to go for a talk/ chat. they would have just told you to stop acting like a child , warned you what could have happened if the lass took it further and then sent you on your way.

been there done that . none of it was official , all of it was just the police being reasonable.

Going to a prearranged appointment for an interview means that you can choose when to go there. If they suspect you are involved in being guilty of an offence, you will be arrested when you get there. If you don't make an appointment then you don't get to choose when you are arrested. This is different to giving a witness statement if you aren't suspected of being involved.

They can't just give you a caution, you have to accept it. And they aren't to be accepted lightly either.

You don't need to accept it. It's a statement of your rights, not a question.

Don't go to the interview, get them to come to you, at a time which is convenient to you.

If the police visit you, it'll likely be at their convenience, not yours.

If they ask to come in ask for a warrant :) youve done nothing wrong, so you can be as arsey as you like

If they suspect you of being guilty of an offence, they don't need a warrant to enter your house and arrest you.
