eBay seller problems..

See these all the time so thought I might as well post.

OK so a buyer has done me over, he wanted a partial refund on a perfectly good TV (just trying to get a quick, cheaper sale). As always I lost the case as a seller (annoying, I put this TV up 2 months ago as I had problems with the buyer before not collecting and having me on then...). So now I have to issue him a full refund.

So I've lost the case, how do we sort out postage? Am I at right to pay for his postage back to me? Or can I say I will only give him the refund for the TV if he pays for the postage? How's it work?

I know I'd be ****ed off if I had to pay postage for something I didn't want but I really don't want to give the guy money for wasting my time and trying to do me over. Don't feel like I should be out of pocket because he bought a TV and decided he didn't want it.

Why did you lose the case?

Ebay/Paypal are ******s but they generally need a better reason than "I've changed my mind and don't want the item".
 
I lost because of the smallest scratch on a black glossy TV edge that you can only see if you shine a bright light on. Was sold as used, general wear and tear..

So if he wants my refund, he has to pay the postage? eBay can't make me do anything else?
 
Yes he pays for the postage. If he doesnt return the tv you can claim the funds back via paypal. He will then have to prove he posted it back

Unless you ticked "New" then there shouldnt be a problem!? Id appeal it.
 
Ring them up and windmill over it. What is the actual situation? Have they taken they money out of your paypal account? Is it even in your paypal account?
 
Well I had a stinking seller ecounter. Won an auction for a brand new mobile phone for my dad bday. When it arrived it was used and had tones of private messages in the phone, lots of photos records, wallpaper of his son, USB and charging cable have been used. It annoys me because I bid on it believing it's a brand new phone but he has been using it at least since 31st May. I ended up buying another new phone for my dad. Now I'm thinking perhaps I should keep the used phone if he's willing to give partial refund to reflect the condition as a used phone but the seller just ignore me. I don't feel like losing out for paying postage to get my refund, the seller should be the one paying my return postage since he lied in his auction.

Generally speaking, if you open a case with paypal and win, you'll get a refund straight away, I would open a case if I were you (on eBay or PayPal) and stress the fact that it's used and not as advertised. A partial refund can be the outcome of this, even at eBay's discretion.

I bought a Wii from eBay last year that had a missing controller and the seller was dragging their feet a bit (it was supposed to be an official one) they were going to buy a controller and have it sent to me, but were insisting on sending me a third party one (I had bid on and won a Wii describing it as having multiple official controllers) so I opened a case with eBay, and they themselves offered me an £80 refund and let the seller keep all their money too.

I ticked used. Explained everything, I'm just worried he messed the TV up himself now....

I can't appeal, the only button eBay have now given me now I've lost the case is 'give refund'. It's so annoying as I know that TV was perfectly fine and described fine :(

I'm not sure what happens when I press the refund button, it tells me to only press it once I've received the item. I'm hoping I get to choose how much to refund and paypal don't just add his postage fees to it. He emailed me yesterday and said the eBay report said that I have the pay for postage...
 
I would suggest you not refund it at all to be honest, if they're not forcing you to, then you can check if he's damaged the TV yourself, I don't suspect you'll be able to choose how much to refund.
 
Don't refund, screw him and screw ebay/paypal. If they find against you without giving a reason then ignore it. They aren't the law.

EDIT: Also remove all money from your paypal account immediately.
 
Let me tell you how crafty Ebay are, one of my mates used my Ebay to buy a Nokia N97 a few weeks ago and I payed for it and everything only for him to change his mind and he no longer wanted the phone. I contact the seller to ask for a refund and I would agree to cancellation so he doesnt lose his funds, and not to send to save us both time - seller refused. I contacted ebay and there answer was to say that when I receive the item to just say it was not as described, even knowing full well that nothing at all is wrong with it.

Basically Ebay actually told me to say it was not as described, and then I would win the case in the resolution center.

As a buyer on ebay you cannot fail, but as a seller you will 99% of the times fail against a case, its too biased towards buyers.

some of the suggestion on here are awful .... sorry but theres a lot of signs that people dont use ebay a lot especially from a sellers perspective.

1) if a case has been launched , ebay will lock your paypal account.you can not get access to ANY funds in the account at the time.
2) If ebay has sided with the buyer (common practice) then you need to get on the phone ,send emails ,double check your listing and complain about it - it MAY get you somewhere. Moaning about it on here aint gonna change anything.
3) as per ebays T+C's HE pays for postage not you, so email him and kindly direct him to the page. HE must clearly ship it recorded, if he doesnt send it within a reasonable amount of time (a few weeks) he can not get a refund. If you yourself do not know the T+Cs i suggest you go read them.

you are given weeks to sort this out between you, the buyer and ebay - so why does it sound like you sent one email the whole time subsequently screwing yourself over by lack of contact when the ebay despute timer ran out??

I'd just like to say that I'm yet to lose a case either as a buyer or a seller.
I've had my fair share of people not reading descriptions correctly and not banking on the fact I'd taken down details of serial numbers and taken photo's of the items I was selling.

So long as you prepare for the worst - you will not lose.

If for example I'd been selling the television in question and I knew it was marked I'd have taken a picture of the marks sot he buyer was aware and if EBay need to investigate they would see that the buyer had seen everything.
If there were no marks I'd have taken 3 or 4 pictures of the item showing its perfect condition.

I know some people can't be bothered with the hassle.
EBay is not the place it was many years ago, but I still make a little money with sales on there and never have any hassle.
 
To be honest I considered the marks so minute I didn't bother taking pictures of them. I even sent pictures of the TV condition before where you can't see them (OK it wasn't a flash camera but who wants a flash camera on a glossy black TV) to eBay.

And no, this case went on for 4 weeks of emailing (he was even sending emails to two of my private email addresses as he got hold of them!). We must have had 20 email exchanges. That's why I'm so annoyed I lost the case as I put a very clear case forward in the eBay thing. Complained plenty to eBay but they didn't listen..

I think a key thing of this is when the case is very first opened it eBay tells you 'We recommend you side with the buyer'.

Paypal is linked to my bank account at the moment, should I remove that?

Seriously can't believe this one guy can screw me over so much for a TV he didn't want/wanted a cheeky extra bit of money off it.
 
I would refuse any refund, and just ignore any more messages from him/ebay/paypal and make sure you have no funds in paypal and make sure its not linked to your bank account.
