This discussion has been had before on here I think. I class kicking someone in the head when they are down and defenceless as trying to kill them. What else can it be, certainly not self defence of any kind.

As someone who has kicked someone while they were on the ground unconscious I will say this.

I did not know he was unconscious, had I done I wouldn't of kicked him, someone can go from being on the ground to getting back up very quickly and I didn't want that happening. My main objective was to cause pain or unconciousness not death.

My brother got a beating a few years back on halloween. They knocked him to the ground, and stamped on his face. To the point you could see shoe impressions in the bruising.

The results of that attack, pretty much mirror this attack.

1 guy got jailed due to it being a repeat offence. And 2 guys with him were given suspended sentences, They had to pay damages to my brother, which they did in monthly payments, and they had a 7pm curfew for 6 months.

My mother was furious that they werent all jailed. Considering the fact the whole attack was caught on CCTV. but my brother seemed pretty understanding at the fact they didnt.

To be honest, The main thing that makes this particular case so bad(the one in the OP), is the celebration. The guys that hurt my brother, They seemed pretty miserable. Not due to remorse I'm sure, more down to the fact they had to pay out cash, and were no longer allowed out after 7pm.

Yes, as if a Judge goes outside the guidelines either way it can be appealed, and the guidelines are freely available to see (as are the judges reasons).
When you look at the guidelines and the reasons you can play "work out the sentence" as well, and probably get something close to what the judge handed down.

From memory almost anyone can appeal if they think a sentence is too short, whilst the defendant can appeal if the sentence is too long (I think a MOP asked for a high profile sentence to be looked at again recently).

It's the government that sets the guidelines the Judges have to abide by, and quite happily lets them take the flak for being "soft on crime" whilst the Judges (and Magistrates) usually are not exactly free to come out and say "it's the idiots in government who decide how we sentence".
 
Think about it like this, the jails are practically full, since you really cannot fill it to 100% otherwise the entire system would halt.

So you cant just throw every dick, tom and jerry in prison.
