Terrible initial launch. Bad communication throughout.
I am actually dumbfounded with what is going on. A company with Blizzards experience and financial backing should not have these problems.
How were these problems not caught before release?

just managed to get a game going, was logged in the whole time but couldnt make a game. can now though.

I get the feeling this is all because the game is a one-off fee rather than subscription based.
These downtimes will eventually mean that some people stop bothering to play, these people that stop playing also happen to be those that are least likely to use the RMAH, meaning that their loss is of little concern to Blizz as they won't make any more money from them anyway. The decreased numbers trying to log in over time free up the servers so those that still play regularly no longer get any errors, consequently Blizz is forgiven because they have 'fixed the problems'.
It's just not seen as that big of a deal to warrant extra server power I'm afraid, they'll have been told the cost limits for servers and it looks like they're sticking to it.

It's incredibly poor. They have direct control of how many licenses are available in each geography, yet "Servers are busy". Well, why are they still selling digital download versions of the game when they don't even have the infrastructure to support the copies they've already sold, making them completely useless?

Agreed. They've taken the money upfront but I'm sure they realise they have a reputation to stand up to.
no point farming for items anywhere other than inferno tbh - i have been finding legendarys and set items in act 1 inferno from treasure goblins, elites, and even just normal mobs..
