I came the closest I ever have to hitting a pedestrian/coming off a couple of days ago. I was doing a loop and was going about 25-30mph at the time. A pedestrian from the opposite side of the road started to cross and I could've sworn she looked my way when she stepped out. Anyway she continues to cross as I'm coming down and it's only when she starts crossing the central line that I realise she's a douche. She carries across and normally I then go behind (almost to overtake her) whilst shouting out to alert her to my presence, at which point she decides not to do the thing that most people do and finish her crossing as quickly as possible, but she actually takes a couple of steps back into my new path. I was this <-> close to hitting her or losing control of the bike.
Stopped a fair few metres down and gave her a good shouting at and she admitted to not looking at all.
Question is, I know what to do if a car hits me or visa versa, but what can you do if you hit a pedestrian and it's their fault (with witnesses)? Is there even any point in getting details and the police etc? Can you take them to a small claims court seeing as they don't have insurance? Or is it literally just "oh well, they smashed up a £1k bike and broke your arm, move along..."
If I'd hit her she would definitely have been spending the night in hospital.
