Ebay dispute

A prime example of why I never sell through Ebay, PayPal are absolute idiots who just shovel cases away from them without taking in the full facts. They always side with the buyer and the sellers tend to get no protection what so ever.

My gripe also with this, you could do every precaution available have proof in emails that should in theory aid all sellers cases but alas they will side with the buyer.
 
Always PHONE PayPal in this sort of dispute, their automated system is not capable of dealing with anything more complex than "it arrived broken", that why he won this case.
 
I can't believe it. Got an email and they have sided with him. The item is visually broken beyond repair now and I have to take it back and issue a full refund.

Ebay never asked us anything they sided with him straight away. He has also had the cheek to email and say is it worth sending back as his son flew it into a try and it is pretty mangled now.

Does anyone know if there is any appeals process?



Not sure about appeal process with ebay/paypal, but you can file a complaint with the financial ombudsman on basis that paypal acted unfairly in refunding the buyer at your expense forsaking your concerns and strong evidence of wrong doing on the part of the buyer. Advantage over the small claims court is that this does not cost anything.

Indeed, it's because Paypal always want to be shown to help the buyer at every opportunity. They've become lazy and now side with the buyer without getting full facts together of the case.

However, what other alternatives are there? There aren't really. It makes Ebay a safe environment, but also encourages ***** to be able to buy and then scam away.

Yes this is the first dispute we have ever had. We sell loads of RC planes and Helicopters on there it is a kind of side line and we have never had a complaint.

I will never sell anything again from there now. Ebay seems to work by two rules.

1. Ebay sides with buyer
2. If Ebay is ever unsure see rule number 1
 
This is why it is not worth selling anything on eBay. I don't bother now and I would tell anyone only sell junk on there and not something that you think has any value.

PayPal always sides with the buyer. I once sold an MP3 player on eBay. The buyer left positive feedback and then broke it. They then claimed for a refund and PayPal was on their side. There is no reasoning with them. They follow a script and you can't win.
 
Could you persue this through small claims if he has admitted his son flew it into a tree causing the damage?

I hope you take him to the cleaners (for at least the money back), I really hate people that do this - and is also a reason I'd never use eBay again.
 
You have been advised what to do from the start; you have to phone them. You have chosen to ignore this and you have come off worse, exactly what was predicted.

If you can afford to lose £120+ or just can't be bothered, continue to send emails, if you want any chance of appealing, you must phone them.

Never sell online auctions
Always put a high buy it now on
Accept reasonable best offers from good rep people

Still nothing is guaranteed with ebay.. Except the buyer always wins.

Sorry to hear that OP. Only sell things you can afford to loose.

Absolutely, if you have any will to fight this, you need to phone them, present your case and go from there.

Get on the blower.
 
eBay/Paypal are hilarious when it comes to making decisions as to who is at fault. I imagine they have so many thousand a day that they almost automatically side with the buyer unless you kick up a fuss as the seller.
 
Just got off the phone with them and they haven't even looked at the case. It seems their siding is almost automated. They are looking at the appeal process which could take up to 45 days. They did admit no matter what I do he is likely to win.

In the meantime my partner has cancelled her card on her account and made sure with the bank there is no other way Paypal can raid her bank.

The other thing is she has just realised the address on her Ebay account is one she moved from 5 years ago.

We will make it as difficult as we can for this clown to get his money back.

As you have proof plane was undamaged ebay will side with you (probably)
Paypal will not refund, as long as you have proof of delivery.

But if they side with buyer, he must return the item to you before they refund, so dont accept/sign the package when it arrives, so paypal will not have there proof of receipt.
