Lowcostholidays has gone bust

What? No, it's nothing to do with Lastminute.com.

He's simply highlighting a section of the T&C's from a competitor which indicates there may be some sort of comeback from former Spanish registered firms.

It would be, had you not just made it up :p

err the link he gave says holidays through lastminute.com is booked through lowcostholidays and your contract is with them??????

When you book a pre-packaged holiday through the Holiday path on the lastminute.com UK website (a “Holiday”)your contract for your holiday will be with Lowcostholidays Spain, S.L. trading and registered at Calle Ada Byron s/n, Planta Baja, Puerta 5-A, Edifico Estel, Parc Bit, Son Sardina, Majorca (“we”, “us”, and “our”) and these conditions detail the terms which will apply to your contract.

so what am I missing?

Which is worth every penny.

I don't think it is if your booking with a recognised ATOL/ABTA registered travel agent

You're missing nothing - I am

That's insane. Wow.

Those T&C's are pretty shocking I'm willing to bet very very few people who book through last minute have a clue that they effectively book a holiday with a different company it boarders on dishonest if you ask me!

My flights are apparently still valid but I'll have to pay for the accommodation again and my airport transfers (about £800 in total) and then try and claim it all back.

Just come off the phone to the Post Office Credit Card people and it seems I have to put everything in writing and send it in a letter over to Dublin. Looks like this is going a very slow process, so bye bye holiday in October.

It may not be that slow, when the company involved is obviously out of business before providing the goods/services it's straight forward however as it is a legal process they need the paperwork.

For example when Courts went bust my parents had just ordered a carpet with fitting and delivery.
Barclaycard got it sorted in about 4 weeks from start to finish with a full refund even though Courts had offered to let us collect the carpet after about 2 weeks (on the advice of BC they turned that down).
The key was that they had paid for everything but only part was going to be fulfilled.

Yeah doesnt exactly mention anywhere on the front pages of Lastminute.com that you are really just booking through another company and they are just an agent.

Suppose it just goes to show, you really need to read those damn T&Cs

Won't help OP but maybe some others, I've just been on the phone with Last minute and they've confirmed that my holiday is fine, so it's not every one that's affected.

Booked a holiday through sunshine, who then used locostrooms to book the hotel part of the holiday.

sunshine have said they'll sort it, either the same hotel, suitable alternative or refund (it has atol protection).

Very nervous at the moment, uncertainty is killing me!

Lots of other tickets etc booked for holiday.

Speaking from experience (I had a holiday booked through Purple Holidays with Goldtrail, who went under in 2010 just before we were due to go).

Yes you will get your money back if booked through an ATOL/ABTA protected travel agent, but don't expect it any time soon! From memory it took me 6+ months, and that was with me pestering them week in week out, I remember searching well over a year later and people were still waiting.

It seems i should be covered according to money saving expert...

PayPal. If you paid by PayPal, you're covered by its buyer protection scheme – but only if you raise a dispute within 180 days of paying. A spokesperson told us: "Purchasers of holidays from Lowcostholidays paid for with PayPal are indeed covered under PayPal buyer protection. They have 180 days from the date of payment to open a dispute relating to the payment."

It seems those doing this stand a good chance of getting a speedy resolution. One Lowcostholidays customer told us: "I have put a claim in with PayPal and they have assured me that I will get the full amount back after 10 days if no response from Lowcostholidays".

I also popped into my bank and asked their advice, they have filled in a chargeback form and we'll just have to see if either of those options gets me my money back.

I used these guys in 2012 and at the time they were ATOL protected.

I doubt I would have re-checked their ATOL status if I was going to use them again, I didn't realise you could even come out of it.

Update:

Just had an email from Paypal and they have decided in my favour after discussing with LCH administrators and as my flights are still valid, they have refunded the cost of the hotel so we've not lost anything :)

Result.

We also got our full hotel money refunded from Mastercard even though I paid by debitcard. I cancelled and rebooked the same hotel with a better room for a lower price. It was a bit of a stressful few weeks not knowing what was going to happen with the money but a good result in the end.
