Cex scumbags have screwed me

Collect+ have confirmed that they have no record of the parcel being opened, though are currently suggesting claiming the parcel as lost, so that's likely the path i'll have to pursue.

Frustrating.

Why would Collect+, who have completed there contract by delivering the parcel, 'investigated' and concluded that the parcel was not tampered with, turn around and tell you claim its lost ?

It clearly was not lost by them, so why would they want to take liability ?
 

Hardly surprised at the response from the Police, I know one of the large supermarkets near me don't bother calling the police when they catch a shoplifter unless its at least £200 in value, below that they get a telling off and held in a security room for a few hours just to pee them off. All because the Police won't bother unless its worth their time.

Who ever said crime doesn't pay, obviously hasn't tried steeling things in 2018!
 
CEX hilariously now claim that they have the parcel being opened carefully and the packaging being discarded in the recycling (surprise! No chance of me inspecting for any tampering now then!) all on CCTV and the Xbox was mysteriously missing, yet I can’t see any photos / video due to data protection. The police won’t contact Microsoft to ban the console / report it stolen (they don’t have the time to do that apparently) and Microsoft support won’t tell me the enforcement process for stolen items or talk to me about it for “safety and security” reasons.

All in all it’s a pathetic disgrace of an answer from all sides.

It clearly was not lost by them, so why would they want to take liability ?

Collect+ say they have no record of the parcel being opened but admit that it is possible that it was tampered with (as they don’t weigh the items etc). Hence why they suggest the lost parcel route.

Open a case at small claims court, I expect they will have to show the cctv footage there if they have it?

I would expect Microsoft (if you have serial number) would possibly be able to know if the console comes online, ip address etc. which could then possibly be used to track it, but the mountain of data privacy laws makes this difficult, almost certainly it would need a request from law enforcement for them to do it.

So I see it as you have 2 options.

1 - Get in writing (email or letter) from CEX that they are prepared to declare with confidence with CCTV footage as evidence the box came empty. You then use this as proof to the courier that the box wasnt delivered as supplied, however I think this is pointless if you have no insurance cover with collect+.
2 - Open a small claims case, you taking a punt CEX are telling fibs, and they will fail to provide the evidence and you get reimbursed.

Tell them the new GDPR (new data protection law) requires them to show you all data that belongs to you which includes CCTV of your package which contains your address and personal data (return address), they can blur out the face of the people in the footage and there is a very large fine for not complying in the new law. Also mention they need to keep the CCTV footage to show you later as you are considering a small claims case at court.

GDPR doesn't take effect until May though?
 
I sold my PS4 slim to them just after black Friday as they were still paying out silly prices. I wouldn't have got as much on here at the time. I took it into the shop though, as I couldn't trust posting it off.

I have only ever sold anything to CEX in the shop, I would never post anything to them (or music magpie etc.) as you really don't know what the person opening the box is like.

I would only sell and post on MM but at the moment I've a GTX 970 and 240Gb SSd I need to put on and I cba with the hassle so may just hang onto them.
 
It’s CEX! They’re a high street shop that is also a nationwide chain! If I can’t trust them to not steal things I doubt I can trust John Lewis etc.

CEX is also a ***** hub that stinks of poverty! John Lewis is nice, clean, and overpriced.

Guy at work bought a phone from CEX that was blacklisted. They refunded the money, but they apparently don't do anything but ban the seller. It's not reported to the police or anything :confused:
