I'm not certain about the complexities of Article 5. However in this case it will likely depend on where the ship was situated when it was attacked (whose waters?), what it was doing. I mean if this was in Romanian waters i'm under the impression that Romania would be within their rights to invoke Article 5. However lets not go jumping to conclusions until they they know the facts.
